Toll Booth Attendant Killed After Suspected Drunk Driver Crashes Into Beach Entrance Booth in Daytona Beach Shores

Michael T. Flanagan, Esq.

A devastating crash in Daytona Beach Shores claimed the life of a toll booth attendant Monday afternoon after a pickup truck allegedly driven by an impaired motorist crashed through a beach access toll booth and continued onto the beach, according to the Volusia County Sheriff’s Office.

The fatal collision occurred shortly before 1 p.m. at a beach ramp entrance off Dunlawton Avenue and has prompted a criminal investigation into whether alcohol played a role in the crash.

Authorities say the driver was taken into custody, and additional charges may be forthcoming pending toxicology results.

What We Know About the Fatal Daytona Beach Shores Crash

According to the Volusia County Sheriff’s Office, the crash occurred around 12:40 p.m. when a pickup truck traveling eastbound on Dunlawton Avenue struck a beach ramp toll booth occupied by a toll attendant.

Investigators reported that:

  • The pickup truck crashed directly into the toll booth
  • The booth was occupied at the time of impact
  • The toll booth was crushed by the collision
  • The truck continued through the structure and onto the beach
  • The vehicle ultimately entered the ocean area and became stuck in the sand

Authorities identified the victim as Tammy Joe Baker, 62.

She was pronounced dead as a result of the crash.

Sheriff Says Driver May Have Been Impaired

Volusia County Sheriff Mike Chitwood stated that deputies suspected impairment after responding to the scene.

According to the sheriff:

  • The vehicle was reportedly traveling approximately 40 miles per hour
  • Deputies detected a strong odor of alcohol
  • The driver was taken into custody
  • Blood alcohol testing was ordered

Investigators are awaiting the results of toxicology testing before determining what criminal charges may be filed.

At this time, authorities have not released additional information regarding the driver’s identity or potential charges.

Workplace Fatalities Can Occur Without Warning

The tragic death of Tammy Joe Baker highlights the dangers faced by workers whose jobs place them near active roadways.

Employees working in toll booths, construction zones, traffic control areas, parking facilities, and roadside locations are often vulnerable to negligent drivers.

These workers frequently have little or no opportunity to avoid a collision when a vehicle unexpectedly leaves the roadway.

Impaired Driving Continues to Cause Preventable Deaths in Florida

Alcohol-impaired driving remains one of the leading causes of fatal traffic crashes throughout Florida and the United States.

According to safety experts, impairment can affect:

  • Reaction times
  • Judgment
  • Coordination
  • Decision-making abilities
  • Ability to remain within a travel lane

Even relatively short periods of impaired driving can result in catastrophic consequences for innocent motorists, pedestrians, workers, and bystanders.

If investigators determine that impairment contributed to the crash, the driver could potentially face significant criminal penalties under Florida law.

Depending on the circumstances, charges may include:

  • DUI manslaughter
  • Vehicular homicide
  • Reckless driving causing death
  • Other felony offenses

Criminal proceedings are separate from any civil claims that may arise following a fatal crash.

Wrongful Death Claims After Fatal DUI Crashes

When a person is killed because of another driver’s negligence or impairment, surviving family members may have the right to pursue compensation through a wrongful death claim.

Under Florida’s Wrongful Death Act, eligible family members may seek damages for:

  • Funeral and burial expenses
  • Medical expenses incurred before death
  • Loss of financial support
  • Loss of companionship and protection
  • Mental pain and suffering

Civil claims can provide accountability and financial support for families facing an unexpected and tragic loss.

Potential Liability Beyond the Driver

Although the primary focus of the investigation remains the driver, certain circumstances may warrant examination of additional parties.

Depending on the facts, investigators and attorneys may review:

  • Vehicle ownership
  • Alcohol service establishments
  • Employer liability issues
  • Vehicle maintenance concerns

Determining all potentially responsible parties is often an important part of a comprehensive investigation.

The Impact on Families and Communities

Fatal crashes involving impaired driving often leave lasting emotional and financial consequences for surviving family members.

For loved ones, the loss is particularly painful because these incidents are frequently preventable.

The death of a worker simply performing her job responsibilities has deeply affected the Daytona Beach Shores community and serves as a reminder of the importance of responsible driving.

Preserving Evidence Following a Fatal Crash

In serious injury and wrongful death cases, critical evidence may include:

  • Toxicology results
  • Crash reconstruction analysis
  • Surveillance footage
  • Witness statements
  • Vehicle data recordings
  • Law enforcement reports

Prompt investigation is often necessary to ensure important evidence is preserved.
