Tesla Cybertruck Driver Arrested After Boca Raton Hit-and-Run Injures Bicyclist in Crosswalk
A Miami man has been arrested after authorities say he struck a bicyclist with a Tesla Cybertruck in Boca Raton, Florida and fled the scene without stopping to render aid.
According to the Boca Raton Police Department, the crash occurred on April 4, 2026, along Northeast Spanish River Boulevard. Investigators say the victim was riding her bicycle through a marked crosswalk when she was struck by a dark-colored Tesla Cybertruck allegedly traveling eastbound in the westbound lanes. Witnesses told police the driver continued into a nearby shopping plaza without stopping to assist the injured bicyclist.
Police later identified the driver as Raul Quintana Menduet, 58, of Miami, after witnesses obtained the vehicle’s license plate number. Investigators allege he admitted he knew he struck the bicyclist but drove away after seeing her stand up and believing she was not seriously injured. He was arrested and charged with leaving the scene of a crash involving injury, a felony under Florida law.
Florida Drivers Must Stop and Render Aid After Injury Crashes
Under Florida Statute § 316.062, drivers involved in crashes resulting in injury are legally required to:
- Immediately stop at the scene or as close as possible
- Provide identifying information
- Render reasonable assistance to injured persons
- Contact law enforcement if necessary
Failing to stop after injuring a bicyclist or pedestrian can result in serious criminal penalties and may significantly increase civil liability exposure.
Driver-Assist Technology Does Not Eliminate Legal Responsibility
Investigators say the driver claimed the Tesla Cybertruck was in “Autopilot” mode at the time of the crash.
However, advanced driver-assistance systems such as Tesla Autopilot do not relieve a driver of the duty to operate a vehicle safely. Drivers remain legally responsible for:
- Monitoring roadway conditions
- Maintaining control of the vehicle
- Obeying traffic laws
- Avoiding pedestrians and bicyclists
- Remaining at the scene of any crash
Claims that a vehicle was in Autopilot or driver-assist mode generally do not excuse negligent driving or fleeing the scene.
Potential Civil Liability in Bicycle Hit-and-Run Cases
In addition to criminal charges, the driver may face civil liability for the bicyclist’s injuries.
Potential liability may extend to:
- The negligent driver who struck the bicyclist
- The vehicle owner, if different from the driver
- An employer, if the driver was operating the vehicle for work purposes
- Potentially the manufacturer, if a vehicle defect or malfunction contributed to the crash
A detailed investigation is often necessary to determine whether the vehicle’s driver-assist systems functioned properly and whether product liability issues may also be implicated.
Damages Available to Injured Bicycle Accident Victims
Victims injured in bicycle crashes may be entitled to pursue compensation for:
- Medical expenses
- Future medical treatment
- Lost wages and reduced earning capacity
- Pain and suffering
- Emotional distress
- Permanent injury or disability
Even when injuries initially appear minor, crash victims should seek prompt medical evaluation, as some injuries may worsen over time.
