Princess Cruise Crew Member Dies After Going Overboard Near Cancun During Voyage from Fort Lauderdale

Michael T. Flanagan, Esq.

A crew member aboard the Regal Princess has died after going overboard during a Caribbean cruise that departed from Port Everglades in Fort Lauderdale, according to Princess Cruises.

The incident occurred near Cancun, Mexico, prompting a search-and-rescue response involving local authorities and another cruise ship before the voyage continued.

What We Know About the Incident

According to Princess Cruises, the Regal Princess departed from Port Everglades in Fort Lauderdale on Saturday for a seven-day Caribbean itinerary.

During the voyage, a crew member went overboard while the ship was sailing near Cancun.

Princess Cruises confirmed that:

  • The crew member died following the incident.
  • The individual’s identity has not been publicly released.
  • Local authorities responded to assist with the search-and-rescue effort.
  • The crew of the Carnival Jubilee also assisted during the emergency response.
  • Grief support services are being provided to both passengers and crew members affected by the incident.

After the search concluded, the Regal Princess resumed its voyage and departed the waters near Cancun.

The ship is scheduled to continue its itinerary with a stop in Belize before returning to Fort Lauderdale on July 18.

Investigation Into the Incident

Princess Cruises has not released information regarding the circumstances that led to the crew member going overboard.

It is common for incidents occurring at sea to involve investigations by multiple entities, which may include:

  • The cruise line.
  • Maritime authorities.
  • Flag state investigators.
  • Local authorities with jurisdiction over the incident.
  • Other agencies, depending on where the event occurred.

At this time, no additional details have been released regarding how the incident happened.

Cruise Ship Overboard Incidents

Although overboard incidents are relatively uncommon compared to the millions of passengers and crew members who sail each year, they often require immediate emergency response efforts involving ship personnel, nearby vessels, and local maritime authorities.

Cruise lines maintain emergency procedures designed to respond quickly to overboard reports, including search operations, coordination with rescue agencies, and onboard support services for passengers and crew.

The legal rights available after a fatal incident aboard a cruise ship depend on the specific facts of the case, including where the incident occurred, the employment status of the individual, the cruise ticket contract, and the maritime laws that apply.

If an investigation determines that negligence contributed to a crew member’s death, surviving family members may have legal options under federal maritime law or other applicable laws.

Depending on the circumstances, compensation may be available for:

  • Funeral and burial expenses.
  • Medical expenses incurred before death.
  • Lost income and financial support.
  • Loss of companionship and support, where permitted by law.
  • Other damages available under applicable maritime statutes.

Crew members often have legal rights that differ from those of passengers because their employment is governed by maritime law, international conventions, and employment agreements.

Every maritime wrongful death case is unique and should be evaluated based on the facts developed during the investigation.

Evidence Can Be Critical in Maritime Cases

Determining what occurred aboard a cruise ship often depends on preserving evidence as early as possible.

Important evidence may include:

  • Ship surveillance video.
  • Crew witness statements.
  • Bridge and navigation logs.
  • Incident reports.
  • Shipboard communications.
  • Electronic tracking data.
  • Rescue operation records.
  • Employment and training records.

Prompt preservation of this evidence can be important in determining whether negligence contributed to the incident.

Investigation Continues

Princess Cruises has not released additional details regarding the circumstances surrounding the crew member’s death.

Further information may become available as maritime authorities and the cruise line complete their investigation. We extend our sincere condolences to the crew member’s loved ones and to all those impacted by this loss.
