The Dangers of Motorcycle Accidents on Highways
Motorcyclists are particularly vulnerable in collisions with larger vehicles, especially on highways where speeds are higher.
Common risks include:
- Vehicles drifting or changing lanes without checking blind spots
- Limited visibility of motorcycles compared to larger vehicles
- High-speed impacts leading to loss of control
- Lack of physical protection for riders
Even minor contact can lead to catastrophic outcomes for motorcyclists.
Common Causes of Lane-Departure Crashes
Crashes involving a vehicle veering out of its lane may be caused by:
- Distracted driving
- Fatigue or drowsy driving
- Impairment
- Mechanical issues or sudden loss of control
Determining the cause is critical in evaluating liability.
Legal Considerations in Motorcycle Crashes
Motorcycle crashes often involve complex liability issues, particularly when another vehicle crosses into the rider’s path.
Investigators may examine:
- Lane positioning and driver behavior
- Vehicle speed and road conditions
- Witness statements and physical evidence
- Possible driver negligence
When a driver fails to maintain their lane, they may be held responsible for resulting injuries or fatalities.
Wrongful Death Claims Under Florida Law
Under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26, families who lose a loved one in a crash may be entitled to pursue compensation.
Damages may include:
- Funeral and burial expenses
