A pedestrian was killed early Wednesday morning after being struck by an SUV on U.S. 1 in Cutler Bay, Florida, according to the Florida Highway Patrol.
The fatal crash occurred during early morning hours, when visibility is often reduced and traffic patterns can be unpredictable.
What We Know About the Crash
According to the Florida Highway Patrol, the crash happened around 3:46 a.m. on April 15, 2026, near Southwest 184th Street. Investigators say a man attempted to cross the southbound lanes of U.S. 1 outside of a designated crosswalk when he was struck by a Kia SUV.

The crash led to a temporary closure of U.S. 1 for approximately two hours while troopers conducted their investigation. The roadway has since reopened.
Dangers of Pedestrian Accidents on Major Roadways
Pedestrian crashes on highways and major arterial roads like U.S. 1 are often severe due to vehicle speeds and limited pedestrian infrastructure.
Common risk factors include:
- Crossing outside of designated crosswalks
- Reduced visibility during nighttime or early morning hours
- High-speed traffic conditions
- Limited lighting in certain areas
Even when pedestrians are partially at fault, these incidents frequently result in catastrophic or fatal injuries.
Legal Considerations in Pedestrian Fatality Cases
Determining liability in pedestrian crashes can be complex and depends on multiple factors.
Potential issues that may be evaluated include:
- Whether the driver was speeding or distracted
- Visibility conditions at the time of the crash
- Roadway design and lighting
- Whether the pedestrian had a safe opportunity to cross
Even in cases where a pedestrian was outside a crosswalk, drivers still have a duty to exercise reasonable care to avoid collisions.
Wrongful Death Claims Under Florida Law
Under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26, surviving family members may be entitled to pursue compensation if negligence contributed to the crash.
Damages may include:
- Funeral and burial expenses
- Medical expenses related to the incident
- Loss of financial support and services
- Loss of companionship and protection
- Mental pain and suffering
Each case must be carefully evaluated to determine whether a claim is viable.
