Melbourne Police Investigate Traffic Homicide After Fatal Motorcycle Crash

Michael T. Flanagan, Esq.

A fatal motorcycle crash in Melbourne, Florida is now being investigated as a traffic-related homicide after a 24-year-old man died from his injuries late Sunday night, according to the Melbourne Police Department.

The crash involved a single motorcycle that left the roadway and struck multiple fixed objects.

What We Know About the Crash

According to the Melbourne Police Department, officers responded to a 911 call around 11:40 p.m. on May 4, 2026, near the intersection of Montreal Avenue and Highland Avenue.

When officers arrived, they found that a motorcycle had left the roadway and crashed into:

  • An aluminum fence
  • A concrete light pole
  • A concrete fence post

The rider, identified as 24-year-old Omar Benkhye of Palm Bay, was ejected from the motorcycle during the crash.

He was transported to a local hospital by Brevard County Fire Rescue, where he later died from his injuries.

Authorities confirmed that the rider was not wearing a helmet at the time of the crash.

Traffic Homicide Investigation

The crash has been classified as a traffic-related homicide, and the Melbourne Police Department Traffic Enforcement Unit is actively investigating.

A traffic homicide designation does not necessarily mean criminal charges have been filed but indicates that the crash involved a fatality and requires a detailed investigation into the cause.

Authorities are asking anyone with information to come forward.

The Dangers of Motorcycle Crashes

Motorcycle crashes often result in severe or fatal injuries due to the lack of protection for riders.

Common contributing factors include:

  • Speeding or loss of control
  • Roadway hazards or obstacles
  • Limited visibility
  • Failure to wear protective gear

When a motorcycle leaves the roadway, the risk of striking fixed objects—such as poles or fences—significantly increases.

The Importance of Helmet Use

Helmet use is one of the most critical safety measures for motorcyclists.

Not wearing a helmet can lead to:

  • Increased risk of traumatic brain injury
  • Higher likelihood of fatal outcomes
  • More severe overall injuries

While Florida law allows certain riders to operate without a helmet under specific conditions, doing so carries significant risks.

In fatal motorcycle crashes, investigators may examine:

  • Speed and driver behavior
  • Roadway conditions
  • Possible involvement of other vehicles
  • Mechanical issues with the motorcycle

If another party contributed to the crash, legal liability may arise.

Wrongful Death Claims Under Florida Law

Under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26, families who lose a loved one in a crash may be entitled to pursue compensation.

Damages may include:

  • Funeral and burial expenses
  • Loss of financial support
  • Emotional pain and suffering
  • Loss of companionship

Investigation Ongoing

The Melbourne Police Department continues to investigate the crash.
