Man Arrested After Shooting at Margate Shopping Plaza Injures Two People

Michael T. Flanagan, Esq.

A 19-year-old man has been arrested in connection with a shooting at a shopping plaza in Margate that left two people hospitalized earlier this month, according to police.

Authorities say Joan Ferrer Azuaje was arrested May 15 in Hillsborough County and now faces multiple felony charges, including attempted murder, child abuse, felony criminal mischief, and discharging a firearm in public.

The shooting occurred May 9 at a shopping plaza located in the 300 block of South State Road 7, according to the Margate Police Department.

The incident highlights the serious dangers posed by public shootings in commercial areas and raises important legal questions involving negligent security, premises liability, and civil claims for victims injured during violent incidents.

What We Know About the Margate Shopping Plaza Shooting

According to police and court records, the shooting stemmed from a confrontation involving Azuaje and three other individuals at the shopping plaza.

Authorities say gunfire erupted during the altercation, resulting in two people being hospitalized with injuries.

Police also confirmed that a 10-year-old child was present during the incident but was not physically injured.

Investigators arrested Azuaje in Hillsborough County on May 15. Records indicate he was later extradited to Broward County and is currently facing an immigration hold.

At this time, authorities have not publicly released:

  • The identities of the injured victims
  • The extent of the victims’ injuries
  • What led to the confrontation
  • Whether additional suspects may be involved

The criminal case remains ongoing.

Public Shootings Raise Serious Safety and Liability Concerns

Shootings occurring in shopping plazas and commercial properties often create significant safety concerns for customers, tenants, and surrounding communities.

Commercial property owners and businesses generally have a legal duty to maintain reasonably safe premises for lawful visitors under Florida law.

When violent crimes occur on commercial property, investigators may examine whether:

  • Adequate lighting existed
  • Security personnel were present
  • Surveillance systems were operational
  • Prior criminal activity occurred nearby
  • Property owners failed to address known safety concerns

In some cases, businesses or property owners may potentially face negligent security claims if foreseeable criminal activity was not reasonably addressed.

Florida Negligent Security Law

Negligent security cases fall under Florida premises liability law.

Property owners may potentially be held liable when inadequate security measures contribute to foreseeable violent crimes.

Courts often evaluate factors such as:

  • Prior criminal incidents in the area
  • Whether the property was located in a high-crime area
  • Existing security measures
  • Whether management responded to known risks

Potential negligent security issues may involve:

  • Poor lighting
  • Lack of security patrols
  • Broken gates or locks
  • Inadequate surveillance cameras
  • Failure to warn visitors of known dangers

Importantly, property owners are not automatically liable simply because a crime occurred. Liability generally depends on whether reasonable safety precautions were taken under the circumstances.

Victims of Violent Crimes May Have Civil Claims

Individuals injured during shootings or violent incidents may potentially pursue compensation for:

  • Medical expenses
  • Lost wages
  • Rehabilitation costs
  • Pain and suffering
  • Emotional trauma
  • Future medical treatment

Civil injury claims are separate from criminal prosecutions and may proceed independently regardless of the outcome of criminal charges.

Victims injured in public shootings often experience long-term physical and psychological trauma that extends well beyond the initial incident.

Child Endangerment Concerns During Public Shootings

Authorities also charged Azuaje with child abuse after police said a 10-year-old child was present during the shooting.

Children exposed to violent incidents may experience:

  • Emotional trauma
  • Anxiety
  • Post-traumatic stress
  • Long-term psychological effects

Even when children are not physically injured, the presence of firearms and violence in public spaces can create serious emotional and safety concerns.

The Importance of Thorough Violent Crime Investigations

Investigations into public shootings often involve extensive evidence collection, including:

  • Surveillance footage
  • Witness statements
  • Ballistics evidence
  • Digital communications
  • Crime scene reconstruction

Prompt investigations can help determine:

  • How the confrontation escalated
  • Whether additional individuals were involved
  • Whether preventable safety failures contributed to the incident

In commercial property cases, investigators may also review security footage retention policies and prior incident reports.

Compassionate Guidance for Victims After Violent Incidents

The Margate shopping plaza shooting is another reminder of how quickly violence can erupt in public spaces and forever change the lives of victims and families.

Those injured during violent incidents often face not only physical recovery, but also emotional trauma, financial stress, and uncertainty about their legal rights.

As the criminal case continues, additional details may emerge regarding the events leading up to the shooting and whether any additional parties may share responsibility.

If you or your family were injured during a violent incident at a Florida business or commercial property, you may have legal options.
