  • Right-of-way and traffic control at the intersection.
  • Vehicle speeds.

Motorcycle Collisions Can Result in Catastrophic Injuries

Motorcyclists face significantly greater risks than occupants of passenger vehicles because they have little physical protection during a collision.

Even crashes that occur at relatively moderate speeds can lead to severe or fatal injuries. For this reason, every fatal motorcycle accident requires a careful investigation before determining how the collision occurred or whether any party may have been negligent.

A fatal motorcycle crash does not automatically establish legal responsibility for any party. A thorough investigation is necessary to determine whether negligence contributed to the collision.

If another driver’s negligence or another contributing factor played a role, eligible surviving family members may have the right to pursue a wrongful death claim under Florida’s Wrongful Death Act (Florida Statutes §§768.16–768.26).

Depending on the facts of the case, compensation may be available for:

  • Funeral and burial expenses.
  • Medical expenses incurred before death.
  • Loss of financial support and future income.
  • Loss of companionship, guidance, and protection.
  • Mental pain and suffering for eligible surviving family members.

In some cases, investigators may also determine that additional factors contributed to the collision, including roadway hazards, defective vehicle components, or other negligent parties. Each case depends on the evidence developed during the investigation.

A civil wrongful death claim is separate from any criminal or traffic investigation and focuses on whether negligence contributed to the fatal crash.

Preserving Evidence Is Important

Evidence collected immediately after a fatal motorcycle collision can be critical in determining liability.

Important evidence may include:

  • Florida Highway Patrol crash reports.
  • Crash reconstruction analysis.
  • Photographs of the vehicles and crash scene.
  • Surveillance or traffic camera footage.
  • Witness statements.
  • Vehicle event data, when available.
  • Medical and emergency response records.

Prompt preservation of this evidence can help ensure an accurate understanding of how the collision occurred.

Investigation Continues

The Florida Highway Patrol continues to investigate the fatal motorcycle crash near Highway 87 and Segura Street in Navarre.

Additional information may be released as investigators complete their review.

The loss of a loved one in a motorcycle accident is a heartbreaking tragedy. We extend our sincere condolences to the family and friends of the man who lost his life and to everyone affected by this devastating crash.
