Hit-and-Run Crashes in Miami-Dade
Sadly, fatal hit-and-run crashes like this are all too common in South Florida. Miami-Dade County regularly sees some of the highest numbers of pedestrian-involved crashes in the state. Many of these incidents occur during early morning or late-night hours when visibility is low and road traffic is minimal, creating dangerous conditions for pedestrians.
Under Florida law, leaving the scene of a crash involving death is a first-degree felony, punishable by up to 30 years in prison, a $10,000 fine, and a mandatory driver’s license revocation. When someone is seriously injured or killed, the driver is legally and morally required to stay at the scene, render aid, and notify emergency services.
Who Can Be Held Responsible After a Fatal Hit-and-Run?
In cases like this, the driver who fled is the primary party at fault and may face criminal and civil penalties. However, there may be additional avenues for recovery:
Government Liability: If poor lighting, lack of signage, or dangerous road design contributed to the crash, local municipalities could be held partially liable under Florida law.
Uninsured Motorist (UM) Coverage: If the victim had auto insurance with UM coverage or was a passenger in a covered vehicle, the policy may provide financial compensation even if the driver is never identified.
Family members may be entitled to compensation through a wrongful death claim under Florida Statutes § 768.21, including damages for funeral costs, loss of companionship, and emotional suffering.
If you’ve lost a loved one in a hit-and-run accident in Miami-Dade or anywhere in South Florida, you may feel helpless, angry, and overwhelmed. But you don’t have to face this tragedy alone. A wrongful death attorney can help you:
- Conduct an independent investigation to identify the driver
- Work with law enforcement and forensic experts to track down evidence
- File insurance claims and explore all available sources of compensation
- Pursue justice through a wrongful death lawsuit
