Deadly Collision at Port Charlotte Intersection: Pedestrian Killed in Crash at U.S. 41 and Conway Boulevard

Michael T. Flanagan, Esq.

A tragic collision in Port Charlotte has claimed the life of a pedestrian after a vehicle struck him at a busy intersection on Saturday evening. The Florida Highway Patrol (FHP) is investigating the fatal crash, which occurred on November 22 at the intersection of U.S. 41 and Conway Boulevard.

According to FHP, a vehicle attempting to make a left turn onto Conway Boulevard collided with a 57-year-old pedestrian who was in the intersection. The pedestrian suffered critical injuries and was transported to a nearby hospital where he was later pronounced dead. The driver was not injured and remained at the scene. Troopers have not released the identity of the victim, and the investigation remains ongoing.

Intersections along U.S. 41 in Charlotte County are known for heavy traffic, frequent turning movements, and limited visibility at certain times of day. When a driver attempts a left turn, the risk to pedestrians increases significantly, especially if the driver:

  • Fails to yield the right of way
  • Misjudges the pedestrian’s speed or distance
  • Is distracted or fatigued
  • Fails to check crosswalks before turning
  • Is speeding or driving aggressively

Even in cases where a pedestrian is outside a designated crosswalk, Florida law does not automatically absolve the driver of responsibility. Investigators must determine whether the driver took reasonable steps to avoid the collision.

Determining fault in a fatal pedestrian crash involves a detailed analysis of evidence from the scene. Under Florida law, drivers have a duty to exercise due care to avoid hitting pedestrians. This includes slowing down, checking crosswalks, and making safe turns.

Liability may be established if the driver was:

  • Turning without ensuring the intersection was clear
  • Distracted by a phone, navigation system, or other device
  • Driving too fast for conditions
  • Failing to yield to a pedestrian already in the roadway
  • Impaired or fatigued

Florida’s comparative negligence system allows fault to be shared among parties. Even if the pedestrian contributed to the circumstances of the crash, surviving family members may still pursue compensation if the driver’s negligence played a role.

Wrongful Death Options for Families in Charlotte County

A fatal pedestrian crash creates sudden emotional and financial hardship for surviving family members. Under Florida’s Wrongful Death Act, families may be entitled to recover compensation for:

  • Funeral and burial expenses
  • Loss of companionship
  • Mental pain and suffering
  • Loss of financial support and household services
  • Medical expenses incurred before death

Because intersection crashes often involve turning vehicles, camera footage, and multiple witnesses, early legal intervention is critical.

Key Evidence That Can Strengthen a Wrongful Death Claim

To determine what happened in the moments leading up to the crash, an attorney may gather and analyze:

  • Traffic camera and surveillance footage from nearby businesses
  • Black box data from the vehicle
  • 911 recordings
  • Eyewitness statements
  • Vehicle damage patterns
  • Roadway markings such as skid or yaw marks
  • Street lighting and visibility conditions
  • Cell phone records, if distracted driving is suspected

Preserving this evidence quickly is often essential for proving liability.
