Deadly ATV Crash in Marion County Leaves Teen Girl Dead, Another Critically Injured

Michael T. Flanagan, Esq.

A tragic ATV crash in Marion County, Florida on Monday evening resulted in the death of an 18-year-old woman and left an 18-year-old man with critical injuries, according to the Florida Highway Patrol.

The crash occurred around 6:20 p.m. near Northeast 171st Avenue Road, where authorities say the ATV lost control and collided with trees in a wooded area.

What we know about the crash

Investigators with the Florida Highway Patrol reported that the ATV was traveling along a dirt path when the crash occurred. Based on the preliminary investigation:

  • The ATV’s left handlebar struck a standing tree while in motion
  • The impact caused the driver to lose control of the vehicle
  • The ATV veered off the path into a wooded area
  • The vehicle overturned and collided with a second tree

The female passenger was pronounced dead at the scene. The male driver was transported to HCA Ocala Regional Medical Center with critical injuries.

Authorities also confirmed that neither occupant was wearing a helmet at the time of the crash, which may have contributed to the severity of the injuries.

ATV accidents and serious injury risks

ATV crashes can be particularly dangerous due to the lack of structural protection and the high likelihood of ejection during impact or rollover events.

Common factors in serious ATV accidents include:

  • Loss of control on uneven or off-road terrain
  • Collisions with fixed objects such as trees
  • Lack of protective equipment, including helmets
  • Carrying passengers on vehicles not designed for multiple riders
  • Excessive speed or unsafe maneuvering

When an ATV overturns or strikes a fixed object, riders are often thrown from the vehicle, significantly increasing the risk of fatal or catastrophic injuries.

Although some ATV crashes are classified as single-vehicle incidents, there may still be important legal considerations depending on the circumstances of the crash.

Potential avenues for liability and legal claims may include:

  • Negligent operation of the ATV, including unsafe speed or improper handling
  • Defective ATV design or mechanical failure, such as steering or braking issues
  • Dangerous property conditions, including poorly maintained trails or hidden hazards
  • Third-party negligence, if another person contributed to the conditions leading to the crash

In cases where a passenger is injured or killed, there may be a claim against the driver if negligent operation played a role in the crash. Additionally, product liability claims may arise if a defect in the ATV contributed to the loss of control.

Families of victims may be entitled to pursue a wrongful death claim under Florida law, which can include compensation for:

  • Funeral and burial expenses
  • Loss of companionship and support
  • Medical expenses incurred prior to death
  • Emotional pain and suffering

Injured survivors may also pursue compensation for medical bills, rehabilitation costs, lost income, and long-term disability.

A thorough investigation is often necessary to determine whether liability extends beyond the immediate circumstances of the crash.

Investigation ongoing

The Florida Highway Patrol continues to investigate the ATV crash in Marion County that claimed the life of a young woman and left another individual critically injured.

As more details become available, authorities will work to determine the full cause of the crash and whether any additional factors contributed to the incident.
