Cocoa Man Killed in I-95 Hit-and-Run Crash Near SR-528
A 29-year-old Cocoa man was killed early Thursday morning in a tragic hit-and-run crash on Interstate 95 in Brevard County, according to the Florida Highway Patrol (FHP). Investigators are now searching for the driver responsible.
Troopers say the deadly crash occurred at approximately 3:35 a.m. on northbound I-95 near State Road 528.
According to the FHP’s preliminary investigation:
- A pedestrian was walking south on the northbound paved shoulder of I-95
- A vehicle traveling north veered onto the shoulder and struck the pedestrian
- The driver did not stop and fled the scene
- The 29-year-old victim from Cocoa was pronounced dead at the scene
Authorities believe the vehicle involved may have been a red semi-tractor trailer. Investigators located debris at the scene and say the truck may have damage to its right front bumper and right turn indicator.
The Florida Highway Patrol is actively searching for the vehicle and driver involved in the fatal hit-and-run. Officials are urging anyone with information to come forward.
Witnesses or anyone with relevant information can contact:
- Florida Highway Patrol by dialing **FHP (347)
- Crimeline at 800-423-TIPS to remain anonymous
All northbound lanes of I-95 in the area were temporarily shut down following the crash but reopened approximately two hours later.
Legal Implications of Hit-and-Run Fatalities
Hit-and-run crashes often leave families with unanswered questions and devastating loss. Under Florida law, drivers involved in a crash causing injury or death are legally required to:
- Stop immediately
- Render aid or call for emergency assistance
- Provide identifying and insurance information
Failing to do so can result in serious criminal charges, including felony hit-and-run involving death.
Even when a driver flees the scene, families of victims may still have legal options. Potential sources of compensation can include:
- Uninsured/underinsured motorist (UM) coverage
- Claims against commercial trucking companies
- Third-party liability if negligence contributed to the crash
A thorough investigation is often necessary to identify all responsible parties.
Wrongful Death Claims After Fatal Pedestrian Accidents
When negligence leads to a fatal crash, surviving family members may be able to pursue a wrongful death claim to recover compensation for:
- Funeral and burial expenses
- Medical costs prior to death
- Loss of financial support
- Loss of companionship and guidance
- Emotional pain and suffering
Cases involving commercial vehicles or semi-trucks can be particularly complex and may involve federal trucking regulations and corporate liability issues.
