What Can Cause a Motorcycle Crash on an Interstate?
Determining what caused a motorcycle accident can require a detailed investigation, particularly when there are few witnesses or limited information available immediately after the crash.
Potential factors investigators may examine include another driver’s actions, unsafe lane changes, speeding, distracted driving, road conditions, mechanical problems or debris in the roadway.
Motorcycles are particularly vulnerable on highways because riders have substantially less physical protection than people traveling inside passenger vehicles. Even when a rider is wearing a helmet and other protective equipment, a high-speed collision can result in catastrophic or fatal injuries.
There is currently no indication in the information released by FHP that any particular factor caused the I-10 crash.
Liability After a Fatal Florida Motorcycle Accident
Not every single-motorcycle crash is necessarily caused solely by the motorcyclist.
For example, another driver could potentially contribute to an accident without actually striking the motorcycle. A driver who makes an unsafe lane change, cuts off a motorcyclist or forces a rider to take evasive action could potentially bear responsibility if evidence establishes that those actions caused the crash.
Dangerous roadway conditions or defective motorcycle components may also become relevant in some cases.
Determining liability requires examining the evidence rather than relying only on where the motorcycle ultimately came to rest.
Evidence in a serious motorcycle accident investigation may include witness statements, surveillance or traffic-camera footage, physical evidence from the roadway, vehicle damage and electronic data from vehicles involved.
Wrongful Death Claims Following Florida Motorcycle Crashes
When a motorcyclist dies because of another person’s negligence, certain surviving family members may have rights under the Florida Wrongful Death Act.
Depending on the circumstances, a wrongful death claim may allow eligible survivors to pursue compensation for certain losses resulting from the death, including lost financial support and services, medical and funeral expenses, and other damages permitted under Florida law.
A fatal crash does not automatically create a wrongful death claim. Evidence must establish that another person or entity was legally responsible for causing the accident.
Families who believe another party may have contributed to a fatal motorcycle crash can speak with a Florida wrongful death attorney about investigating the collision and determining whether a claim may exist.
