Bunnell Woman Killed in Rear-End Collision With Truck on SR-100 in Flagler County

Michael T. Flanagan, Esq.

A 44-year-old woman from Bunnell was killed Monday morning in a rear-end collision involving a truck on State Road 100 in Flagler County, according to the Florida Highway Patrol (FHP).

Troopers said the crash occurred around 11:00 a.m. as the woman was driving a sedan eastbound on SR-100 near Bertha Road. For reasons that remain under investigation, the sedan struck the rear of a truck driven by a 48-year-old man.

The woman died as a result of the crash. The truck driver sustained minor injuries, according to FHP. No further details regarding the cause of the collision have been released at this time.

While rear-end crashes are often associated with lower-speed traffic, collisions on state roads like SR-100 can be deadly—particularly when vehicles are traveling at highway speeds or when a smaller passenger vehicle strikes a larger truck.

Factors commonly involved in serious or fatal rear-end crashes include:

  • Sudden traffic slowdowns or stops
  • Driver distraction or inattention
  • Speeding or following too closely
  • Brake failure or mechanical issues
  • Roadway design or visibility limitations

Even when a crash appears straightforward, determining legal responsibility often requires a detailed investigation into vehicle speeds, braking behavior, traffic conditions, and mechanical factors.

When a motor vehicle crash results in death, surviving family members may have the right to pursue a wrongful death claim under Florida’s Wrongful Death Act (Florida Statutes §§768.16–768.26).

In Florida, a wrongful death claim must be brought by the personal representative of the deceased person’s estate on behalf of surviving family members, which may include a spouse, children, or parents.

Depending on the circumstances, recoverable damages may include:

  • Funeral and burial expenses
  • Medical expenses related to the fatal injury
  • Loss of financial support and services
  • Loss of companionship, guidance, and protection
  • Mental pain and suffering of surviving family members

Florida follows a modified comparative negligence system (§768.81), meaning fault is allocated among the parties involved. Recovery may be barred only if the deceased is found to be more than 50% at fault. In rear-end collisions, liability may depend on factors such as sudden stopping, mechanical failure, or unsafe driving behavior by one or more parties.

Law enforcement investigations focus on determining how a crash occurred and whether traffic citations are warranted. They do not evaluate civil liability or pursue compensation for grieving families.

An independent legal investigation may help preserve and analyze critical evidence, including:

  • Crash reconstruction and vehicle damage analysis
  • Event data recorder (black box) information
  • Brake and mechanical system inspections
  • Traffic flow and roadway conditions
  • Witness statements and surveillance footage
  • Insurance coverage and policy limits

This evidence is often essential in wrongful death cases—especially when fault is disputed or multiple factors may have contributed to the crash.
