Apollo Beach Man Killed in Crash on U.S. 41 in Ruskin, FHP Reports
A tragic crash in Ruskin, Florida claimed the life of an 89-year-old Apollo Beach man after a collision involving two vehicles on U.S. 41, according to the Florida Highway Patrol.
The crash occurred late Sunday morning and left multiple people injured.
What We Know About the Crash
According to the Florida Highway Patrol, the crash happened around 11:15 a.m. on April 12, 2026, along U.S. 41 just south of 4th Street South. Investigators say the 89-year-old man was driving a Kia Soul and was attempting to exit a gas station on the east side of the roadway when he made a left turn into the path of an oncoming Hyundai Tucson traveling northbound.
Troopers say the Hyundai struck the Kia, causing the Kia Soul to overturn while the Hyundai came to rest in the median. Both drivers and a 72-year-old female passenger in the Hyundai were transported to the hospital with injuries. The driver of the Kia later died from his injuries. Authorities have not released the names of those involved.
Risks Associated With Left-Turn and Intersection Crashes
Crashes involving left turns across traffic are among the most common and dangerous types of roadway collisions, particularly on busy highways like U.S. 41.
Common contributing factors include:
- Failure to yield the right of way
- Misjudging the speed or distance of oncoming traffic
- Limited visibility when exiting private property
- High traffic volume on major roadways
These types of crashes often result in severe impacts, especially when vehicles are struck from the side or overturn following a collision.
Legal Considerations in Multi-Vehicle Crashes
Determining liability in intersection and turn-related crashes requires a detailed analysis of the events leading up to the collision.
Potential liable parties may include:
- The turning driver, if they failed to yield to oncoming traffic
- The oncoming driver, if speeding or inattentiveness contributed
- Property owners, if visibility from the exit was obstructed
- Government entities, if roadway design or signage contributed to unsafe conditions
Even when one driver appears primarily at fault, Florida law allows for shared liability depending on the circumstances.
Wrongful Death Claims Under Florida Law
Under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26, surviving family members may be entitled to pursue compensation if negligence contributed to the crash.
Damages may include:
- Funeral and burial expenses
- Medical expenses incurred prior to death
- Loss of financial support and services
- Loss of companionship and protection
- Mental pain and suffering
In cases involving elderly victims, claims may still include compensation for the emotional loss suffered by surviving family members.
Investigation Ongoing
The Florida Highway Patrol continues to investigate the crash, including the circumstances surrounding the left turn and whether any additional factors contributed.
