Accused DUI Driver Arrested Following Deadly Head-On Crash in St. Petersburg
A tragic head-on collision in St. Petersburg has left one woman dead and another man seriously injured, with the alleged drunk driver now facing serious criminal charges.
The crash occurred around 6:30 p.m. Wednesday in the 7800 block of 38th Avenue North, according to the St. Petersburg Police Department.
Investigators say Brett McClelland, driving a Subaru Outback westbound, crossed into oncoming traffic and struck a Toyota sedan head-on. Inside the Toyota, the driver sustained serious injuries, while his female passenger was rushed to the hospital, where she later died from her injuries.
McClelland was also injured and transported for medical treatment. Police determined he was under the influence at the time of the crash. He has since been arrested and charged with DUI manslaughter and DUI causing serious bodily injury.
This heartbreaking crash is another reminder of the devastating consequences of impaired driving in Florida. DUI crashes often involve:
- Severe injuries or fatalities due to the high speed and unpredictability of impaired drivers.
- Legal consequences including felony charges, long prison sentences, and lifetime criminal records for those responsible.
- Emotional and financial devastation for victims’ families, who face medical bills, funeral costs, and the lifelong absence of their loved ones.
Wrongful Death and Injury Claims After DUI Accidents
When a DUI crash results in fatalities or serious injuries, criminal charges are only part of the process. Families and survivors may also pursue civil claims to hold the impaired driver financially accountable.
- Wrongful death claims: The family of the deceased passenger may be entitled to compensation for funeral expenses, loss of companionship, mental pain and suffering, and lost financial support.
- Personal injury claims: The injured Toyota driver may seek damages for medical expenses, lost wages, rehabilitation, and long-term suffering caused by his injuries.
- Punitive damages: In DUI cases, Florida law sometimes allows courts to award punitive damages to punish egregious misconduct and deter future drunk driving.
The loss of life in this crash underscores why Florida law takes DUI manslaughter so seriously. While McClelland faces criminal prosecution, the victims’ families may also find a measure of justice through civil action.
