Michael T. Flanagan, Esq.

A 2-year-old boy tragically died Thursday evening after being found unresponsive in a lake behind a residence in Plantation, according to the Plantation Police Department.

The heartbreaking incident remains under investigation as authorities work to determine how the child entered the water.

What We Know About the Incident

According to Plantation Police, officers responded at approximately 5:35 p.m. on July 9, 2026, to a report of a missing child in the 1600 block of Northwest 108th Avenue.

Investigators reported that:

  • Family members discovered the 2-year-old boy unresponsive in a lake behind the residence.
  • A relative immediately removed the child from the water and began CPR.
  • Responding officers continued lifesaving efforts until paramedics arrived.
  • The child was transported to Broward Health for emergency treatment.
  • Despite lifesaving efforts, he was later pronounced deceased.

The child’s identity has not been released.

Investigation Underway

The Plantation Police Department is actively investigating the circumstances surrounding the drowning.

At this time, authorities have not indicated that foul play is suspected. Investigators will continue reviewing the scene, interviewing witnesses, and examining all available evidence to determine how the child gained access to the lake.

Drowning Remains a Leading Cause of Death for Young Children

According to the Florida Department of Health, drowning is the leading cause of unintentional death among children between the ages of 1 and 4 in Florida.

Young children can access water quickly and quietly, making constant supervision and multiple layers of protection critical around pools, ponds, lakes, canals, and other bodies of water.

While every drowning incident is unique, families may have legal options if an investigation determines that another person or entity’s negligence contributed to the child’s death.

Depending on the circumstances, a wrongful death claim may arise if the drowning resulted from unsafe property conditions, inadequate security measures, negligent supervision by a third party, or another preventable hazard.

Potentially responsible parties may include:

  • Property owners who failed to maintain reasonably safe premises.
  • Homeowners’ associations responsible for maintaining common areas.
  • Apartment or condominium communities that failed to secure lakes, retention ponds, or swimming pools.
  • Daycare facilities, schools, camps, or other organizations responsible for supervising children.
  • Contractors or maintenance companies that created or failed to correct dangerous conditions.

Every case depends on its specific facts, and liability cannot be determined until the investigation is complete.

Florida Wrongful Death Claims

If negligence contributed to a fatal drowning, surviving family members may have the right to pursue a wrongful death claim under Florida’s Wrongful Death Act (Florida Statutes §§768.16–768.26).

Depending on the circumstances, compensation may be available for:

  • Funeral and burial expenses.
  • Medical expenses incurred before the child’s passing.
  • Mental pain and suffering experienced by parents.
  • Loss of companionship and emotional support where permitted by Florida law.
  • Other damages authorized under Florida’s wrongful death statutes.

A wrongful death claim is separate from any criminal or government investigation and focuses on holding negligent parties financially accountable.

Important Evidence in Child Drowning Cases

Determining how a drowning occurred often requires a prompt and thorough investigation.

Evidence may include:

  • Surveillance or security camera footage.
  • Photographs of the property and surrounding area.
  • Fence and gate inspections.
  • Pool or water barrier compliance.
  • Witness statements.
  • Emergency response records.
  • Property maintenance records.
  • Prior reports of safety concerns or code violations.

Preserving evidence early can be important if negligence is suspected.

Water Safety Recommendations

Water safety experts encourage families to use multiple layers of protection, including:

  • Constant adult supervision around any body of water.
  • Four-sided fencing with self-closing, self-latching gates around pools.
  • Door and pool alarms.
  • Age-appropriate swim lessons.
  • CPR training for parents and caregivers.
  • Securing access to ponds, lakes, and canals whenever possible.

No single safety measure can eliminate the risk of drowning, making multiple protective measures especially important for young children.

Plantation Police continue to investigate the circumstances surrounding this tragic incident.

Additional information may be released as investigators determine exactly what occurred.

The loss of a young child is an unimaginable tragedy that forever changes the lives of those left behind. We extend our deepest condolences to the child’s family, friends, and loved ones during this incredibly difficult time.
