19-Year-Old Motorcyclist Killed in Semi-Truck Crash on SR-13 in Fruit Cove: Legal Rights After a Fatal Florida Motorcycle Accident

Michael T. Flanagan, Esq.

A tragic motorcycle accident in Fruit Cove, Florida has claimed the life of a 19-year-old rider after a collision with a semi-truck on State Road 13.

According to the Florida Highway Patrol, the fatal crash occurred on the evening of April 8, 2026, on SR-13 just south of Otoes Place in Fruit Cove. Investigators say the 19-year-old Jacksonville motorcyclist and a semi-truck were both traveling northbound on State Road 13 when the truck driver allegedly made a right turn into a shopping plaza. As the truck turned, the front of the motorcycle collided with the right side of the semi-truck, ejecting the rider onto the roadway. The young motorcyclist was transported to the hospital, where he later died from his injuries. The semi-truck driver, a 61-year-old man from Largo, was not injured.

Although the investigation remains ongoing, the circumstances described raise significant questions regarding whether the truck driver safely executed the turn and properly yielded before moving into the motorcycle’s path.

Semi-Truck Drivers Have a Duty to Ensure Turns Can Be Made Safely

Commercial truck drivers operating large tractor-trailers have a heightened duty to use caution when making turns, particularly when sharing the road with smaller, more vulnerable vehicles like motorcycles.

Because semi-trucks require wide turning radiuses and have significant blind spots, right-turn truck accidents frequently occur when drivers:

  • Fail to check mirrors and blind spots before turning
  • Misjudge the position or speed of nearby vehicles
  • Turn prematurely into the path of another motorist
  • Fail to properly signal their intentions
  • Execute unsafe or improper wide turns

If the truck driver failed to ensure the turn could be completed safely, both the driver and potentially the trucking company may be civilly liable for the resulting death.

Motorcycle Riders Are Particularly Vulnerable in Truck Accidents

Motorcyclists have little protection in collisions involving commercial trucks. Even relatively low-speed impacts can result in catastrophic or fatal injuries due to the size and weight disparity between a motorcycle and an 80,000-pound commercial vehicle.

Unfortunately, truck drivers often fail to adequately account for motorcycles due to their smaller profile and reduced visibility.

Potential Wrongful Death Claim After a Fatal Motorcycle Accident

When a motorcyclist is killed due to another party’s negligence, surviving family members may have grounds to pursue a wrongful death claim under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26.

A wrongful death claim may allow recovery for:

  • Funeral and burial expenses
  • Medical expenses incurred prior to death
  • Loss of companionship and protection
  • Mental pain and suffering of surviving family members
  • Loss of financial support and services
  • Loss of future net accumulations to the estate

Truck Accident Cases Require Immediate Investigation

Fatal truck accident cases are often far more complex than standard motor vehicle collisions. In addition to evaluating driver negligence, investigators may need to determine whether the trucking company itself contributed to the crash through negligent hiring, training, supervision, or maintenance.

Critical evidence may include:

  • Driver logbooks and hours-of-service records
  • Dashcam footage
  • Truck black box / ECM data
  • Driver qualification and training files
  • Maintenance and inspection records
  • Cell phone records
  • Surveillance footage from nearby businesses

Because trucking companies and insurers often begin building their defense immediately, preserving evidence quickly is essential.
