A tragic single-vehicle crash on Interstate 95 in Brevard County has resulted in the death of a motorcyclist after the rider veered off the roadway and struck a light pole. According to the Florida Highway Patrol, the crash occurred near mile marker 176.

What We Know About the Incident

The crash occurred on I-95 southbound near mile marker 176 in Brevard County, Florida

The motorcyclist was traveling southbound at the time of the crash

A witness reported the motorcycle veered off the roadway to the left

The motorcycle struck a light pole

No other vehicles were involved in the crash

The rider was transported to Palm Bay Hospital

The motorcyclist was later pronounced dead

The identity of the victim has not been released

The Florida Highway Patrol is investigating

Risks and Safety Concerns

Motorcycle crashes involving fixed objects—such as light poles, guardrails, or barriers—are often fatal due to the lack of protection for riders. Even a single moment of loss of control can result in catastrophic consequences.

Highway conditions, including speed, roadway design, and traffic flow, can increase the severity of motorcycle accidents. Sudden swerving or overcorrection can cause a rider to leave the roadway.

Additionally, factors such as road debris, mechanical failure, or driver fatigue may contribute to these types of crashes.

Legal Options and Potential Liability

Although this appears to be a single-vehicle crash, liability may still be evaluated depending on the underlying cause.

Potential liable parties may include:

Government entities: If roadway design, maintenance issues, or unsafe conditions contributed to the crash, the responsible agency may share liability.

Vehicle or motorcycle manufacturer: If a mechanical defect or failure contributed to the loss of control, a product liability claim may be evaluated.

Third parties: If another driver or external factor caused the motorcyclist to veer off the road, that party may be held liable.

Maintenance providers: If improper repairs or maintenance contributed to the crash, liability may extend to those responsible.

In fatal crash cases, surviving family members may be entitled to pursue compensation for:

Funeral and burial expenses

Medical costs incurred prior to death

Loss of financial support and future earnings

Loss of companionship and emotional suffering

Investigation Ongoing

The Florida Highway Patrol continues to investigate the crash to determine what caused the motorcycle to leave the roadway.

Authorities are expected to review witness statements, roadway conditions, and potential mechanical factors as part of the ongoing investigation.

A fatal crash in northeast Miami-Dade County has claimed the life of a motorcyclist following a collision with a passenger vehicle. According to the Miami-Dade Sheriff’s Office, the crash occurred on March 24, 2026, on Biscayne Boulevard near Northeast 127th Street. The motorcyclist was pronounced dead at the scene as authorities worked to investigate the incident and manage traffic closures in the area.

What We Know About the Incident

The crash occurred on Biscayne Boulevard near Northeast 127th Street in Miami-Dade County, Florida

The incident took place on the morning of March 24, 2026

The crash involved a motorcycle and a passenger vehicle

The motorcyclist, an adult male, was pronounced dead at the scene

The identity of the motorcyclist has not yet been released

The driver of the vehicle remained at the scene and was not injured

Southbound lanes of Biscayne Boulevard between Northeast 126th Street and 128th Street were closed

Traffic lanes were later reopened after the scene was cleared

The Miami-Dade Sheriff’s Office is investigating the crash

Risks and Safety Concerns

Motorcycle crashes involving passenger vehicles are among the most dangerous types of traffic accidents due to the lack of protection for riders. Even a collision that might be survivable in a car can result in fatal injuries for a motorcyclist.

Busy roadways like Biscayne Boulevard present additional risks due to heavy traffic, frequent lane changes, and turning vehicles. Intersections and access points along major corridors can increase the likelihood of conflicts between vehicles and motorcycles, particularly when drivers fail to properly yield or check for smaller vehicles.

Motorcycles are also less visible than larger vehicles, which can contribute to drivers misjudging distance or failing to notice them altogether. These factors make heightened awareness essential for both drivers and riders.

Legal Options and Potential Liability

Fatal motorcycle crashes often require a detailed investigation to determine whether negligence played a role and to identify all potentially responsible parties.

Potential liable parties may include:

Negligent driver
A driver who fails to yield, makes an improper turn, is distracted, or is speeding may be held liable for causing a collision with a motorcyclist.

Vehicle owner
Under Florida law, the owner of the vehicle may be responsible for damages caused by the driver.

Government entities
If roadway conditions, poor lighting, inadequate signage, or unsafe road design contributed to the crash, the agency responsible for maintaining the roadway may share liability.

Third parties
In some cases, other drivers or external conditions may have contributed to the crash and may be evaluated for liability.

Vehicle or parts manufacturers
If a mechanical defect in either vehicle contributed to the crash, a product liability claim may be pursued.

Under Florida’s comparative negligence system, fault may be apportioned among multiple parties based on their degree of responsibility.

In fatal crash cases, surviving family members may pursue a wrongful death claim and recover compensation for:

Medical expenses incurred prior to death

Funeral and burial costs

Loss of financial support and future earnings

Loss of companionship and emotional suffering

These claims are typically brought by the personal representative of the estate on behalf of eligible survivors.

Investigation Ongoing

The Miami-Dade Sheriff’s Office continues to investigate the crash and determine the circumstances that led to the fatal collision. Authorities are expected to review evidence from the scene, including vehicle damage, roadway conditions, and witness statements.

A fatal crash in Lafayette County has left two motorcyclists dead following a collision with a truck towing a boat. According to the Florida Highway Patrol, the crash occurred on March 20, 2026, around 8:30 p.m. at the intersection of U.S. Highway 27 and County Road 53 in Mayo. Authorities report that the motorcycle struck the boat attached to a pickup truck, resulting in fatal injuries to both riders.

What We Know About the Incident

The crash occurred at U.S. Highway 27 and County Road 53 in Lafayette County, Florida

The incident took place around 8:30 p.m. on March 20, 2026

A Chevrolet pickup truck towing a boat was stopped at a stop sign on County Road 53

The truck was preparing to enter or cross U.S. Highway 27

A motorcycle carrying two individuals was traveling eastbound on U.S. Highway 27

The motorcycle collided with the boat being towed by the truck

Both individuals on the motorcycle were pronounced dead at the scene

The Florida Highway Patrol is investigating the crash

Risks and Safety Concerns

Crashes involving motorcycles and trailers present unique and often deadly risks. Boat trailers can be difficult to see, especially at night, and may extend significantly beyond the towing vehicle, creating an unexpected hazard for oncoming traffic.

Intersections like U.S. Highway 27 and County Road 53 can be particularly dangerous when vehicles enter or cross high-speed roadways. Drivers pulling trailers must account for the additional length and time required to safely clear an intersection. Failure to do so can place other motorists, especially motorcyclists, at significant risk.

Motorcycles are less visible than larger vehicles and provide minimal protection in the event of a collision. When a motorcycle strikes a fixed object such as a trailer, the force of impact is often severe, leading to a high likelihood of fatal injuries.

Legal Options and Potential Liability

Fatal crashes involving trailers and intersections often require a detailed investigation to determine whether negligence played a role. Multiple parties may be liable depending on how the crash occurred.

Potential liable parties may include:

Negligent driver of the truck: If the driver of the pickup truck failed to yield the right of way, misjudged the speed of oncoming traffic, or entered the intersection unsafely, they may be held liable for causing the crash.

Vehicle owner: Under Florida law, the owner of the vehicle may be responsible for damages caused by someone operating their vehicle.

Trailer or equipment manufacturers: If the boat trailer lacked proper lighting, reflectors, or safety features, or if a defect contributed to the collision, a product liability claim may be pursued.

Employers or commercial entities: If the truck was being operated for business purposes, an employer may be held liable under vicarious liability principles.

Government entities: If poor intersection design, inadequate signage, lack of lighting, or unsafe roadway conditions contributed to the crash, the government agency responsible for maintaining the roadway may share liability.

Under Florida’s comparative negligence system, fault may be apportioned among multiple parties based on their degree of responsibility.

In fatal crash cases, surviving family members may pursue a wrongful death claim and recover compensation for:

Funeral and burial expenses

Loss of financial support and future earnings

Loss of companionship, guidance, and protection

Emotional pain and suffering

These claims are typically brought by the personal representative of the estate on behalf of eligible survivors.

Investigation Ongoing

The Florida Highway Patrol continues to investigate the crash and determine the sequence of events that led to the fatal collision. Authorities are expected to review vehicle positioning, lighting conditions, and witness statements to establish liability and identify any contributing factors.

A tragic crash in Orange County claimed the life of a 17-year-old driver from Orlando early Sunday morning, according to the Florida Highway Patrol.

Troopers say the accident occurred on Landstar Boulevard near Island Cove Drive when a 2017 Hyundai Santa Fe, driven by the teen, collided with the rear of a 2007 Honda CR-V around the early morning hours. Both vehicles were traveling southbound when, for reasons still under investigation, the Hyundai lost control after striking the Honda.

The impact caused the Hyundai to veer off the road and onto the median, where it collided with a tree. The teenage driver was transported to Osceola Regional Medical Center but was later pronounced dead. The driver of the Honda, a 42-year-old man from Kissimmee, was not injured and remained at the scene.

Florida Highway Patrol investigators have not yet determined what caused the young driver to lose control. Possible contributing factors in single-vehicle fatalities often include:

Speeding or overcorrection following a rear-end impact

Wet or uneven road surfaces

Driver distraction or fatigue

Sudden mechanical failure or tire blowout

Inexperience behind the wheel

While the investigation continues, this tragedy serves as a painful reminder of how quickly a routine drive can turn deadly — especially for young and inexperienced drivers.

Understanding Liability and Wrongful Death in Single-Vehicle Crashes

Even when only one vehicle appears to be at fault, additional parties may share legal responsibility. For example, if a road hazard, vehicle defect, or another driver’s negligence played a role, families may still have grounds for a wrongful death claim under the Florida Wrongful Death Act (§§768.16–768.26).

Potentially liable parties can include:

Another motorist whose unsafe driving caused the collision

Vehicle manufacturers or tire companies if a mechanical defect contributed to loss of control

Government entities or contractors if dangerous roadway conditions or inadequate signage were involved

Losing a teenage child in a preventable accident is one of the most devastating experiences a family can face. Beyond the heartbreak, parents are often left searching for answers — and accountability. Funeral expenses, medical bills, and emotional trauma can create overwhelming burdens in the wake of tragedy.

Funeral and burial costs

Emotional pain and suffering

A devastating two-vehicle crash in Orlando sent nine children and one adult to the hospital on Thursday evening, with Florida Highway Patrol confirming that charges are pending against one of the drivers involved.

The collision occurred on Raleigh Street near Campanella Avenue in Orlando’s Parramore neighborhood. According to investigators, a 29-year-old man driving an Alfa Romeo was traveling eastbound when he rear-ended a Nissan Altima driven by a 58-year-old woman.

The impact forced the Nissan off the roadway and into a tree. Inside the Nissan were nine children, ages 3 to 14, and one adult woman. First responders described a chaotic scene, with multiple victims needing immediate medical attention.

Orlando Fire Department crews worked to extricate the trapped female driver before transporting her to Orlando Regional Medical Center, where she remains in stable condition.

All nine children were taken to Arnold Palmer Hospital for Children. As of Friday, four of them have been released, while five remain hospitalized. One child is listed in critical but stable condition.

The male driver of the Alfa Romeo was not injured and stayed at the scene to cooperate with authorities. Troopers said charges are pending as the investigation continues, with early findings suggesting the driver was speeding and failed to notice the slowing vehicle ahead.

Rear-end collisions are among the most common — and preventable — types of crashes. Under Florida Statute §316.0895, drivers must maintain a safe following distance and operate their vehicles at a speed appropriate for traffic conditions. Failure to do so can result in both criminal charges and civil liability if others are injured or killed.

When a driver’s reckless behavior — such as speeding or distracted driving — causes a crash involving children, Florida law allows victims and their families to pursue compensation for medical expenses, emotional trauma, and long-term rehabilitation costs.

Children are particularly vulnerable in high-impact collisions. Even when properly restrained, they may suffer severe or life-altering injuries such as:

Traumatic brain injuries (TBI)

Internal bleeding or organ damage

Fractures or spinal injuries

Emotional trauma and PTSD

These injuries often require months or years of treatment and can permanently alter a child’s future. Families in such situations deserve full accountability from negligent drivers and their insurers.

Under the Florida Civil Remedies for Motor Vehicle Accidents and Florida’s Personal Injury Protection (PIP) laws (§627.736), victims can recover medical costs through insurance. However, in cases involving serious injury or permanent impairment — as may be true here — families can also pursue personal injury or wrongful death claims against the at-fault driver.

Potential recoverable damages include:

Hospital and rehabilitation costs

Future medical expenses

Pain and suffering

Emotional distress

Loss of enjoyment of life

If criminal charges are filed, a parallel civil claim may still be pursued to hold the negligent driver financially responsible for the harm caused.

At Flanagan & Bodenheimer Injury and Wrongful Death Law Firm, we represent families across Florida who have suffered catastrophic injuries or the loss of loved ones in preventable crashes. We work closely with accident reconstruction experts and medical professionals to build strong, evidence-based cases.

We purposely maintain a small caseload to give every client — especially those facing tragedies involving children — the time, compassion, and attention they deserve.

A tragic multi-vehicle collision on Florida’s Turnpike in Orange County has claimed the life of 30-year-old Ameer Harcourt Ramouni, the nephew of Dearborn Police Chief Issa Shahin.

According to the Florida Highway Patrol (FHP), the crash occurred on Monday, September 8, 2025, around 8:30 p.m. near Orlando.

Authorities report that a tow truck traveling in the center outside lane attempted to change lanes into Ramouni’s path. Riding his motorcycle in the inside center lane, Ramouni lost control and veered into another lane. Two vehicles traveling nearby were unable to stop in time and struck him. A third vehicle collided with debris from the crash.

Ramouni was tragically pronounced dead at the scene. No other drivers involved reported injuries. The Florida Highway Patrol has confirmed that the investigation remains ongoing.

Chief Shahin shared his grief publicly, writing:

“We are heartbroken by the sudden loss of my nephew Ameer, who passed away in a motorcycle accident in Florida at just 30 years old.”

Originally from metro Detroit, Ramouni had moved to Longwood, Florida, two years ago to complete flight school, with plans to return home to Michigan after obtaining his pilot’s license. His family described him as a “beautiful, kind, and brilliant” young man who will be deeply missed by his loved ones and community.

Legal Considerations in Motorcycle Crashes

This devastating accident highlights the unique dangers motorcyclists face on Florida’s roadways. According to federal data, motorcycle riders are more than 28 times more likely than passenger vehicle occupants to suffer fatal injuries in collisions. Lane changes, particularly by larger vehicles such as tow trucks and tractor-trailers, are a frequent cause of motorcycle crashes due to blind spots, size, and limited reaction time.

If an investigation determines that the tow truck driver’s lane change was negligent, the driver — and potentially the company that employed them — could face liability for wrongful death. Under Florida Statutes §768.21, certain surviving family members may recover damages for:

Funeral and burial expenses

Loss of companionship, protection, and guidance

Loss of financial support and services

Mental pain and suffering of surviving spouses, parents, or children

For grieving families, pursuing legal action is not just about financial recovery. It is also about holding negligent parties accountable and ensuring dangerous driving behaviors are addressed to protect others on Florida’s highways.

Trucking and towing companies may also be investigated for:

Negligent training or supervision of drivers

Failure to enforce safety policies regarding lane changes and blind spots

Maintenance issues that may have contributed to the crash

A tragic incident in Lake Havasu City, Arizona, has reignited concerns over the safety of hyperbaric oxygen therapy (HBOT) chambers. On July 9, Walter Foxcroft, a 43-year-old physical therapist and co-founder of Havasu Health and Hyperbarics, was killed in a flash fire while inside a hyperbaric chamber at his own facility.

First responders with the Lake Havasu City Fire Department and Police Department arrived on scene just before 11 p.m. after a report of a burn-related emergency. Foxcroft was pronounced dead on site.

This marks the second fatal hyperbaric chamber incident in the U.S. this year. In January 2025, a 5-year-old boy in Michigan died under eerily similar circumstances when a chamber caught fire during treatment.

Hyperbaric Oxygen Therapy (HBOT) involves a patient breathing 100% oxygen in a pressurized chamber. Under these conditions, the body is able to absorb more oxygen, which is intended to promote healing for conditions like:

Decompression sickness (common in divers)

Chronic non-healing wounds

Carbon monoxide poisoning

Severe burns or tissue damage

Certain infections

While HBOT has been praised for its potential benefits, this tragedy underscores the inherent risks involved when fire safety protocols and equipment malfunctions come into play.

While the cause of the fire is still under investigation, experts and agencies such as the Food and Drug Administration (FDA) have long warned of the fire hazards associated with hyperbaric oxygen chambers.

Foxcroft was a respected healthcare provider and beloved community member. He co-founded Havasu Health and Hyperbarics in 2024, and had a doctorate in physical therapy from Touro University Nevada. He also graduated from the University of Arizona, where he served as the university’s mascot—a role symbolic of his outgoing nature and dedication to the community.

His sudden passing has sent shockwaves through Lake Havasu and the broader medical community, especially among proponents of alternative and adjunctive therapies like HBOT.

Could This Lead to a Wrongful Death Claim?

Absolutely. When tragedies like this occur, the legal implications depend on the circumstances surrounding the incident:

A wrongful death claim could potentially be pursued if:

The hyperbaric chamber was defective in design or construction.

Manufacturers failed to provide adequate warnings or safety instructions.

Maintenance or operational procedures were neglected.

The chamber was misused due to lack of training or oversight.

If negligence on the part of the equipment manufacturer, facility management, or staff played a role in the fire, Foxcroft’s surviving family may have grounds for a wrongful death and product liability lawsuit.

If you or someone you love has suffered due to a fire or injury related to a medical device such as a hyperbaric chamber, you may be entitled to compensation for:

Funeral expenses

Lost income or future earnings

Pain and suffering

Punitive damages (in extreme cases of negligence)

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we are deeply saddened by incidents like this one. Medical devices are meant to heal, not harm. If they pose risks, those risks must be properly managed, disclosed, and mitigated.

Our firm is committed to uncovering the truth behind tragedies like this and holding negligent parties accountable. If you suspect that a defective medical device or failure to follow safety protocols contributed to a loved one’s death, we are here to help.

A night out turned violent early Friday morning after a seating dispute at a Miami nightclub led to a stabbing, leaving one woman injured and two others in handcuffs.

According to the Miami Police Department, the incident occurred shortly after midnight at The Studio, a nightclub located at 652 Northeast 2nd Avenue in downtown Miami.

The altercation began when one of the suspects reportedly returned to a seat she had previously occupied and found another woman sitting there. According to the arrest report, she asked the woman to move. When the woman refused, a physical fight broke out, escalating quickly into violence.

During the altercation, the victim suffered a 2-to-3-inch stab wound to her back.

Authorities say two women—identified as Jasmine Paisley, 24, and Samantha Davis, 33—were involved in the assault. Both attempted to flee the scene but were quickly apprehended after a brief foot chase, thanks in part to an off-duty police officer who intervened and helped detain the suspects while the victim received medical assistance.

Both Paisley and Davis now face serious charges stemming from the violent altercation. While specific charges have not yet been publicly disclosed, felony aggravated battery with a deadly weapon and attempted murder are potential charges that may apply in stabbing cases like this, depending on the severity of the injury and intent.

If convicted, the suspects could face lengthy prison sentences, particularly given the presence of a deadly weapon and the public nature of the crime.

What Rights Does the Victim Have?

Victims of nightclub violence may have legal grounds for both criminal justice and civil compensation. In cases like this, victims may be entitled to file a personal injury claim against:

The perpetrators of the assault

The nightclub or venue, if there was a lack of adequate security or failure to intervene

Third parties if negligence contributed to the escalation of violence

Under Florida premises liability law, nightclubs have a duty of care to protect patrons from foreseeable harm. If there is a history of violent incidents at the venue or if the club failed to provide proper security or staff intervention, they may be held partially liable for the victim’s injuries.

If the victim chooses to pursue a civil lawsuit, she may be entitled to damages such as:

Medical expenses (emergency care, hospitalization, follow-up treatment)

Lost wages from time missed at work

Pain and suffering

Emotional distress

Future rehabilitation costs

A personal injury attorney can investigate the nightclub’s liability and help hold all responsible parties accountable.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent victims of violent incidents in public venues. If you or a loved one was injured in a nightclub, bar, or restaurant due to negligence or assault, you have rights, and we’re here to help.

A tragic accident in the early hours of Wednesday morning has claimed the life of a 24-year-old woman from Jupiter, following a collision with a semi-truck on Interstate 95 North. According to the Florida Highway Patrol (FHP), the crash occurred around 3:35 a.m., roughly one mile north of the PGA Boulevard exit.

Preliminary reports from FHP state that the semi-truck, a freightliner, was traveling northbound on I-95 when it was rear-ended by a Nissan Sentra driven by the young woman. Troopers say the Sentra approached the truck at a high rate of speed and crashed into the back of the truck’s trailer. The impact caused the vehicle to become lodged underneath the rear portion of the trailer, a particularly devastating type of collision known as an underride crash.

Emergency responders pronounced the woman dead at the scene. Her identity has not yet been released pending notification of next of kin. The driver of the semi-truck was not injured.

Crashes involving passenger vehicles and large commercial trucks often result in catastrophic or fatal injuries, especially in rear-end collisions. When a smaller car strikes the rear of a trailer, the lower profile of the car can cause it to slide underneath the truck in what is known as an underride accident.

These accidents are often deadly due to:

Lack of sufficient underride guards or damaged/missing underride bars

Poor nighttime visibility

High speed impact

Sudden lane changes or driver fatigue

Distracted or impaired driving

Failure to account for slower-moving commercial vehicles

In this case, FHP’s report suggests the Sentra may have been traveling too fast to recognize and react to the slower-moving or stopped semi in time.

When fatal accidents occur, especially those involving commercial vehicles, it’s important to carefully investigate all contributing factors. While early reports suggest the woman was approaching at a high rate of speed, that does not automatically mean she was entirely at fault. Potential avenues of legal inquiry could include:

Was the truck parked or moving unusually slowly?

Was the truck’s lighting or reflective equipment operational and visible?

Was the underride guard compliant with federal safety standards?

Were there any contributing roadway or visibility issues?

If the truck’s operator or the trucking company failed to meet safety regulations, or if there was a mechanical defect in either vehicle, surviving family members may be able to file a wrongful death claim.

Fatal truck crashes are complex and emotionally overwhelming. At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, our attorneys have deep experience handling cases involving commercial trucking companies and wrongful death litigation. We investigate every angle, including accident reconstruction, black box data, and compliance with federal trucking laws.

A fatal workplace accident unfolded Thursday morning in Palm Beach County, when a worker was killed in an industrial incident involving a concrete block machine. According to local officials, the tragic event occurred during what was initially dispatched as a technical rescue, but emergency crews later confirmed that the worker had died at the scene.

The accident reportedly occurred at an industrial facility where concrete products are manufactured. Details about how the incident unfolded remain limited, but authorities confirmed that the worker became fatally injured in connection with the operation of a concrete block machine—a large piece of heavy equipment used to shape and press concrete materials into blocks.

Despite rapid response from paramedics and fire rescue personnel, the worker was pronounced dead on the scene. The Palm Beach County Sheriff’s Office is now leading the investigation into the circumstances surrounding the incident.

As of this writing, the identity of the victim has not been released, pending notification of next of kin.

Workplace incidents involving industrial machinery like concrete block presses are unfortunately not uncommon in high-risk labor environments. Equipment of this scale poses significant danger when safety procedures aren’t rigorously followed, or when equipment malfunctions occur. Potential causes of incidents like this can include:

Lack of proper machine guarding

Improper maintenance or mechanical failure

Inadequate training or supervision

Failure to follow OSHA safety protocols

Entrapment or crushing injuries during operation

Who Is Liable in a Fatal Industrial Accident?

In Florida, employers are legally required to provide safe working conditions under both state and federal occupational safety laws. When a workplace death occurs, several avenues of legal investigation may follow:

1. Workers’ Compensation Death Benefits

In most cases, the family of a deceased worker may be entitled to workers’ compensation death benefits. These benefits are designed to cover funeral costs and provide limited financial support to dependents. However, workers’ compensation also typically prevents the family from suing the employer directly, unless gross negligence or intentional misconduct can be proven.

2. Third-Party Liability Claims

If a third party (such as an equipment manufacturer, contractor, or maintenance company) was responsible for the unsafe condition or malfunction, the victim’s family may be able to file a wrongful death lawsuit. For example:

If the concrete block machine was defectively designed or maintained, the manufacturer or service provider could be held liable.

If an outside contractor operated the machinery negligently, they may be responsible.

3. OSHA Investigation and Safety Violations

The Occupational Safety and Health Administration (OSHA) may also conduct an investigation into whether safety violations contributed to the accident. If violations are found, the employer may face significant fines and mandatory compliance actions.

What Should Families Do After a Fatal Workplace Accident?

If you have lost a loved one in an industrial workplace accident, it is vital to:

Consult with an experienced wrongful death and workplace injury attorney as soon as possible.

Preserve evidence if possible—photos of the scene, witness statements, or safety documentation.

Avoid signing any documents from insurance or the employer without legal guidance.

Request an independent investigation, particularly if machinery or third-party liability may be involved.

Time is critical. In Florida, wrongful death claims are subject to a two-year statute of limitations from the date of death, though action should begin much sooner to preserve evidence and strengthen the case.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent families across Florida who have suffered the loss of a loved one due to industrial accidents, machinery failures, and workplace negligence. We understand how overwhelming these tragedies can be and are committed to fighting for full accountability.

A devastating multi-vehicle crash on I-95 in Brevard County, Florida, has left three people dead and two others seriously injured. According to the Florida Highway Patrol (FHP), the crash occurred around 8:30 a.m. on Friday, March 28, near Mile Marker 201 (King Street), and remains under active investigation. While the cause is still being pieced together, early reports suggest that high-speed fleeing from law enforcement was a contributing factor.

According to the preliminary crash report from FHP:

A 2015 Mercedes was traveling northbound on I-95 and was reportedly fleeing from troopers at the time of the crash.

Two unoccupied tow trucks — a 2005 Ford F-650 and a 2011 Ford F-750 — were parked on the exit ramp shoulder at King Street.

A 39-year-old man was working beneath one of the trucks when the Mercedes veered onto the ramp and struck both tow trucks.

The driver of the Mercedes (41 years old) and the tow truck worker were airlifted to a local hospital with serious injuries.

Three passengers in the Mercedes — two women and one man — were tragically pronounced dead at the scene.

Authorities have not released the names of the deceased as they await confirmation from the medical examiner’s office. The investigation is ongoing, and key questions remain, including why the Mercedes was being pursued and whether protocol was followed during the pursuit.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we offer our deepest condolences to the families impacted by this tragic collision.

Who Can Be Held Liable in a Multi-Car Crash Involving a Police Pursuit?

Florida law allows victims of serious crashes — or their families — to pursue personal injury or wrongful death claims when another party’s negligence or recklessness contributed to the crash.

In this case, there may be multiple parties whose actions could be examined for liability:

The driver of the Mercedes, if found to have been recklessly fleeing law enforcement, could be liable for the resulting deaths and injuries.

The Florida Highway Patrol may also be scrutinized if the pursuit was conducted in violation of department policies, such as chasing a vehicle through a heavily trafficked area at high speeds.

The tow truck companies, depending on whether the trucks were parked in a reasonably safe manner and whether proper safety warnings were in place on the shoulder.

Vehicle manufacturers or parts companies, in the rare event mechanical failure contributed to the crash or injury.

Filing a Wrongful Death Claim After a Fatal Car Accident in Florida

Families grieving the loss of a loved one have the legal right to file a wrongful death claim under Florida law. This is a civil claim, separate from any criminal charges that may stem from the crash. The personal representative of the deceased’s estate — usually a close family member — may file the lawsuit on behalf of the survivors, which may include:

The spouse

Children

Parents

Any dependent blood relatives or adoptive siblings

Wrongful death damages in Florida may include:

Funeral and burial expenses

Medical expenses prior to death

Loss of future income and benefits

Loss of companionship and parental guidance

Mental pain and suffering of survivors

Every case is fact-specific, and when multiple victims are involved — as in this tragedy — it’s critical to have an experienced legal team who can thoroughly investigate all potential sources of liability and ensure your rights are protected.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we focus exclusively on personal injury and wrongful death cases. We intentionally maintain a small caseload, so every client receives direct, personal attention from an experienced attorney. We have recovered millions of dollars for families across Florida and are prepared to take cases to trial when necessary.
Motorcycle accidents can be devastating, leaving victims with severe injuries, costly medical bills, and significant emotional distress. If you’ve been involved in a motorcycle crash in Hollywood, FL, you may be wondering: Do I need a lawyer?

The short answer is yes—having a Hollywood motorcycle accident lawyer on your side can make a huge difference in the outcome of your claim. Insurance companies often try to minimize payouts, and Florida’s motorcycle laws can make it difficult for injured riders to recover full compensation. Here’s why hiring a lawyer is crucial after a motorcycle accident in Hollywood, FL.

Understanding Motorcycle Accidents in Hollywood, FL

Hollywood, Florida, is home to busy roads like Hollywood Boulevard, Sheridan Street, and US-1, which see heavy traffic and frequent motorcycle accidents. Florida has some of the highest motorcycle accident rates in the country due to year-round riding weather and high tourism traffic.

According to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV):

Over 9,000 motorcycle crashes occur in Florida each year.

More than 500 motorcyclists die annually due to accidents.

Thousands of riders suffer serious injuries, often requiring months or years of medical treatment.

Because motorcycles lack the protection of cars, riders are much more vulnerable to life-altering injuries, making it even more important to have a lawyer who will fight for maximum compensation.

When Should You Hire a Lawyer After a Motorcycle Accident?

While some minor accidents may be resolved without legal assistance, there are several circumstances where hiring a motorcycle accident attorney is highly advisable. If any of the following apply to your case, it is in your best interest to consult with an attorney as soon as possible.

1. You Have Suffered Serious Injuries

Motorcycle accidents frequently result in life-altering injuries, including:

Traumatic brain injuries (TBI)

Spinal cord damage and paralysis

Fractured or broken bones

Road rash and severe lacerations

Internal organ damage

Permanent disability or disfigurement

Injuries of this nature often require extensive medical treatment, rehabilitation, and long-term care, leading to overwhelming medical expenses. A skilled motorcycle accident attorney can help assess the full extent of your damages and ensure that you pursue the compensation necessary for both your immediate and future needs.

2. The Insurance Company Is Offering an Inadequate Settlement

Insurance companies prioritize minimizing payouts and often make low settlement offers that fail to cover the full scope of a victim’s medical expenses, lost income, and pain and suffering. Without legal representation, accident victims may feel pressured to accept these initial offers, unaware that they are entitled to significantly more compensation. An attorney can negotiate aggressively with insurance adjusters to ensure a fair and just settlement.

3. The Other Party Is Disputing Liability

Under Florida’s comparative negligence law (Florida Statutes § 768.81), compensation can be reduced if the victim is found partially at fault for the accident. If you are more than 50% at fault, you may be unable to recover compensation. In many cases, drivers or their insurers attempt to shift blame onto motorcyclists to avoid financial responsibility.

A skilled motorcycle accident attorney can gather critical evidence, such as:

Police accident reports

Eyewitness statements

Surveillance footage

Traffic camera recordings

Expert accident reconstruction analysis

By thoroughly investigating the accident, your attorney can disprove false claims of liability and build a strong case in your favor.

4. The Accident Involved a Hit-and-Run or an Uninsured Driver

In cases where the at-fault driver flees the scene or does not have insurance, obtaining compensation can be particularly challenging. Victims may need to file a claim through their own uninsured/underinsured motorist (UM/UIM) coverage, which can be a complex process. A Hollywood motorcycle accident lawyer can help navigate insurance policies, file the necessary claims, and ensure you receive the compensation you are entitled to.

5. The Accident Resulted in a Fatality

If a loved one has tragically lost their life in a motorcycle accident, surviving family members may have the right to file a wrongful death lawsuit under Florida’s Wrongful Death Act (Florida Statutes § 768.16-768.26). A wrongful death claim can help surviving family members recover compensation for:

Funeral and burial expenses

Medical bills incurred before death

Loss of financial support and future earnings

Loss of companionship and emotional suffering

These cases are legally complex, and securing experienced legal representation is essential for ensuring that justice is served.

How Can a Motorcycle Accident Attorney Help?

Retaining an experienced motorcycle accident attorney in Hollywood, FL provides several key advantages, including:

1. Conducting a Comprehensive Investigation

An attorney will conduct a thorough investigation by gathering police reports, interviewing witnesses, analyzing medical records, and working with accident reconstruction specialists to establish liability.

2. Handling All Communications With Insurance Companies

Insurance companies often attempt to limit payouts by using deceptive tactics. A lawyer will manage all negotiations and communications, preventing insurers from using your statements against you.

3. Determining the Full Value of Your Claim

Accident victims are often unaware of the full economic and non-economic damages they are entitled to, including:

Current and future medical expenses

Lost wages and diminished earning capacity

Pain and suffering

Property damage

Loss of enjoyment of life

An attorney ensures that all potential damages are included in your claim.

4. Representing You in Court if Necessary

If a fair settlement cannot be reached, an attorney is prepared to file a lawsuit and take your case to trial. Having legal representation significantly improves your chances of securing maximum compensation.

While nobody wants to think about getting involved in an accident, the reality is that Florida is a busy place, and traffic collisions are going to occur. With so many local and out-of-state drivers, Florida stays packed with traffic all year around. According to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV), there were more than 400,000 total car accidents during the latest reporting year across the state. Out of these incidents, there were 3,135 total fatalities and more than 236,000 injuries. Many Florida collisions involve multiple vehicles, and you need to know what to do in the aftermath of these incidents.

Seek Medical Assistance

The most important thing you can do in the aftermath of any vehicle accident in Florida is to seek medical assistance. Call 911 and make sure that EMS and police are on the way to the crash scene. Even if your injuries seem minor, this does not mean they are not serious. The signs and symptoms of many car accident injuries are not immediately apparent and may appear hours or days after the crash occurs. By seeking medical attention, you are ensuring your well-being and establishing a link between the accident and your injuries.

Document Any Evidence

If you are able to do so safely, you should gather as much evidence as possible at the crash scene. Use a smartphone to take photographs of everything, including vehicle damages, skid marks or debris lying around, injuries, traffic and weather conditions, and more. If there were any eyewitnesses to the crash, get their names and contact information. In the aftermath of a Florida multi-car accident, make sure you get the names, driver’s license numbers, and insurance information of every driver involved.

Reporting to the Insurance Carrier

You need to report the accident to your insurance carrier as soon as possible after the incident occurs. Florida is considered a “no-fault” accident state, which means that drivers turn to their personal insurance carriers for coverage of medical expenses after an accident, regardless of who is at fault. Do not delay reporting an accident, because doing so could jeopardize your ability to receive compensation for your expenses.

Moving Beyond No-Fault Insurance

There are some situations in which the no-fault insurance coverage will not apply. In Florida, drivers can step outside of the no-fault system if the injuries from the accident are permanent, have caused significant scarring or disfigurement, or have caused the loss of important bodily functions. Even if an accident does not cause permanent injury, drivers may be able to pursue damages from at-fault parties if the injury costs total more than $10,000.

Speak to an Attorney

In the aftermath of an accident caused by another driver in Florida, you need to speak to an attorney with extensive experience handling these cases. While no-fault insurance coverage may be sufficient for some accidents, that may not always be the case. If you need to file an insurance claim or a personal injury lawsuit against another driver, you will need an attorney by your side to conduct a thorough investigation into the incident, prove liability, and negotiate on your behalf.

The last thing most people expect is that they will be involved in an accident when they are driving In Florida. The good news is that most car accidents are preventable by safe driving practices as well as preventative maintenance. Tire blowouts can lead to severe accidents, but there are steps that Florida drivers can take to prevent this from occurring.

Maintaining Proper Air Pressure in Tires

You should always maintain proper air pressure in your tires. Not only does this help with gas mileage, but it helps prevent a tire blowout. Vehicle experts recommend manually checking the tire pressure once a month to maintain proper PSI. Newer vehicles typically come with built-in air pressure sensors that will alert the driver when air pressure gets too low, but you should still consider checking your tire pressure manually.

Regularly Check Tire Condition

You should get into the habit of regularly looking at your tires to ensure they are in good condition. Be on the lookout for any visible signs of wear and tear. This can include deformities on the tires, tears on the tires, tire bubbles, and more. If you see anything out of the ordinary, you should not operate the vehicle. Make sure that an automotive expert examines the tires and determines what the problem is and tells you how to fix it.

Replace Tires as Required

The National Highway Traffic Safety Administration (NHTSA) recommends drivers replace tires once every five or six years, or once they have reached the mileage they were rated for. However, those who drive their vehicles regularly or over longer distances may need to replace their tires more often. A key indicator of tire health is tread depth. When a tire’s tread is worn, this can lead to serious roadway safety issues, including tire blowouts.

Do Not Overload a Vehicle

Every vehicle has a maximum weight capacity. Loading a vehicle beyond the recommended weight limits will put too much pressure on a tire and cause a blowout. If you plan on carrying more cargo than you normally would, you need to make sure you know your vehicle’s weight capacity.

If You Do Experience a Tire Blowout

Even if you take all the proper steps to keep your tires roadworthy, there is still a chance that a tire blowout will occur. If you are behind the wheel when a tire blowout occurs, how you react can save your life and the lives of others around you on the roadway. You may hear a loud sound or bang when the tire initially blows, followed by the sound of flopping, deflated tire. You may feel the vehicle began to pull one way or another, depending on which side the tire blowout occurred on.

Keep your hands firmly on the steering wheel, and be careful not to slam on the brakes. Instead, you will want to slow down gradually by taking your foot off the gas pedal and gently applying brake pressure. After your speed has slowed, pull your vehicle into a safe area off the road or in a parking lot. Call for emergency roadside assistance or have a friend come help you put on a spare tire.

Car accidents frequently cause injuries to those involved. Unfortunately, car accident injuries can lead to major medical expenses for victims. In many cases, car accident victims may also experience immense pain and suffering due to the car accident and the correlating injuries. Compensation can be available for pain and suffering, but it is not as easy to calculate as other car accident damages.

Defining Pain and Suffering in a Florida Car Accident

Pain and suffering damages can be differentiated from other damages in a car accident. While these are compensable damages, they are separate from medical expenses and lost income. Pain and suffering damages are used to define the distress that a car accident victim sustains after an accident due to their injuries.

Physical pain and suffering. This refers to the pain that a car accident victim experiences directly caused by their injuries (both right after the incident and throughout recovery).

Mental pain and suffering. This is also related to a victim’s injuries but refers to a wide category of distress that a person could experience. This includes:

Mental anguish

Depression

Loss of enjoyment of life

Emotional and psychological distress

Humiliation

Anxiety

Fear

Anger

PTSD

It is important to recognize that pain and suffering are real for many car accident victims. There is a reason these are considered compensable damages. Pain and suffering can negatively impact a person’s social, family, and work life. Compensation for these damages can help alleviate some of the stress that impacts car accident victims.

How Are Pain and Suffering Damages Calculated?

Pain and suffering damages are different from other types of compensable damages in a car accident case. For medical bills and lost income, a victim will generally have concrete evidence of what the injury has cost them. They will have medical bills and pay stubs to use as proof. However, there are no receipts available for pain and suffering.

The court will consider several factors when working to calculate pain and suffering, including the following:

The severity of the injuries

Whether there will be ongoing consequences

Age of the person injured

The amount of economic loss suffered

In most cases, the value of pain and suffering will be arrived at using a “multiplier” method. Typically, thy attorney will use the economic damages and multiply them by a certain number (usually between one and five). For example, if economic damages come to $100,000 and a multiplier of three is used, the attorney could argue that the victim is entitled to approximately $300,000 in pain and suffering damages.

Recovering Pain and Suffering Damages in Florida

Florida is a “no-fault” accident state. This can limit a victim’s ability to recover compensation for their pain and suffering damages. In general, a victim turns to their own insurance carrier for medical damages after a car accident. Pain and suffering damages can only be recovered if an injury reaches a certain threshold that allows a victim to file a personal injury lawsuit. These thresholds are as follows:

Significant, permanent loss of function

Permanent injury

Disfigurement or permanent scars

A skilled Miami car accident attorney will be needed to review your case and determine how much you could be entitled to.

Motor scooters, or mopeds as they are popularly called, have become very popular in Florida. These vehicles are relatively inexpensive to buy and to ride. Whether Florida residents and visitors use mopeds as their main method of transportation or for recreational purposes, it is important to understand the laws surrounding mopeds in Florida.

Is a License Necessary for a Moped?

A moped is considered a motor vehicle in Florida. To legally ride a moped on any roadway or street, you must be 16 years of age and have one of the following:

A regular driver’s license

A class E license

A motorcycle only license

Nobody with a learner’s permit may operate a moped in Florida. If a person does not have a driver’s license, they can apply for a motorcycle-only license that will permit the operation of a moped on Florida roadways.

Do You Need a License Plate?

Mopeds in Florida are required to carry a license plate and be registered with the Florida Department of Highway Safety and Motor Vehicles (FLHSMV). Plates must be renewed annually. However, a rider does not need to obtain a title for their moped.

What Is Considered a Moped in Florida?

Florida law defines a moped as a vehicle that has:

petals and can be propelled by human power

a seat or saddle for the driver

two or three wheels

a motor with a maximum of two brake horsepower (BHP)

50 cubic centimeters (cc) or less of engine displacement

automatic transmission

Mopeds will not be classified as such if they can go faster than 30 mph on level ground.

Are There Any Other Relevant Moped Laws in Florida?

Moped riders in Florida or not required to wear a helmet or have eye protection while driving a moped. However, if they are transporting a passenger younger than 16, that person must wear a helmet at all times.

Moped riders in Florida are not required to carry insurance. However, moped operators will still be liable for any property damage or bodily injury claims if they are responsible for an accident.

Mopeds are going to be restricted from riding on the interstate. State laws limit moped usability to public highways that have speed limits under 40 mph.

Mopeds are also prohibited from lane splitting, meaning it is illegal to ride on the yellow line between lanes. Mopeds cannot weave in and out of lanes to pass slower-moving traffic.

Mopeds required to maintain a lane position as close to the far right of the lane when traveling at speeds slower than the normal traffic flow. There are exceptions to this, such as when a moped operator is making a left-hand turn or the far right is obstructed by an obstacle.

Mopeds are prohibited from operating on sidewalks or bicycle lanes.

Injuries From These Incidents Can Be Severe

Moped riders have little protection from the force of a vehicle slamming into them. Just like bicyclists and motorcyclists, a moped operator is likely to sustain an injury in the event they are in a crash with a passenger vehicle. It is not uncommon to see the following injuries in the aftermath of the moped accident:

Traumatic brain injuries or head injuries

Spinal cord injuries with paralysis

Internal organ damage or internal bleeding

Broken or dislocated bones

Severe lacerations or amputations

Injured moped riders must seek medical attention as soon as an accident occurs.

There are plenty of motorcycle enthusiasts in Florida who enjoy the sensation and freedom of riding on two wheels. However, motorcycles are inherently riskier than traditional passenger vehicles, so it is important to know the state’s motorcycle laws, particularly those concerning passengers. Here, we want to discuss the most important Florida motorcycle passenger laws you need to know.

Motorcycle Accidents Are Not Uncommon

During the latest reporting year in the state, the Florida Department of Highway Safety and Motor Vehicles states that there were 9,143 total motorcycle crashes reported. Out of those incidents, there were 7,849 injuries and 631 fatalities. When we look more closely at the data, we can see that there were 25 motorcycle passengers killed and 621 motorcycle passenger injuries.

Motorcycle Passenger Laws You Need to Know

Florida law prohibits passengers from riding on motorcycles that are not designed for two people. ON a two-person motorcycle, passengers must ride on the back of the same seat that the driver is using. Or on a separate seat that is attached to the motorcycle. A second seat can be behind or beside the driver’s seat.

Helmets. In Florida, anyone over the age of 21 is not required to wear a helmet if there is an insurance policy that covers at least $10,000. That does not mean a passenger should forego a helmet. These devices save lives.

Footrests. In Florida, a motorcycle must have passenger footrests installed on the vehicle. The passenger should be able to reach the pegs with their feet. If they cannot do so, it could create balance difficulty for the driver of the motorcycle.

Children. In this state, children are allowed to ride on motorcycles, and there is no age restriction. Children must abide by the same safety requirements, and they are required to wear a helmet. It is important to educate children on issues of motorcycle safety as well as the dangers of distracting a driver while riding.

Sidecars. While most motorcycle passengers ride behind the driver and hold on for safety, there are times when a motorcycle has a sidecar for passengers to ride in. Sidecar riders should never distract a driver. If they are under 21, they must wear a helmet. When there is a sidecar, motorcycles do not have to have passenger footrests installed on the bike.

Additional Safety Measures

Motorcycle passengers should never distract a driver while on the roadway. While there is no rule about passengers riding while intoxicated, this should be avoided. The nature of being a motorcycle passenger means that there are safety risks. Passengers should be attentive and able to hold on for safety. A drunk passenger could easily fall off the bike or become a distraction for the driver.

While a helmet is not required for passengers, they should still wear one. A helmet is vital for protecting a passenger’s head and can prevent fatalities.

Injuries Can Be Severe

If a motorcycle crashes, whether with another vehicle or in a single-vehicle crash, motorcycle riders and passengers have a high probability of sustaining an injury. It is not uncommon for the following injuries to occur due to a motorcycle crash:

Broken or dislocated bones

Severe lacerations and road rash

Spinal cord injuries

Open head wounds

Traumatic brain injuries

By following all Florida laws and taking proper precautions, motorcycle drivers and passengers can work to prevent serious injuries. Speak with our Miami motorcycle accident attorneys today at (305) 638-4143.

Florida has more railroad accidents than many other states in this country. When a rail accident occurs, it is not uncommon for serious injuries to occur. A recent article in the Miami Herald points out that Florida ranks sixth out of all states in the US for railroad crossing accidents. Train travel has remained popular, particularly as people look for more environmentally friendly travel methods.

Where Do These Accidents Happen?

Most railroad accidents in the state happen in South Florida, particularly in and around the Miami, West Palm Beach, and Fort Lauderdale areas. Railroad accidents can involve both passenger-carrying trains as well as freight trains. In this area, accidents have occurred on the Florida East Coast Tracks as well as the Tri-Rail tracks.

Accidents are increasing along Brighline rail, which began tests in 2017. This line currently operates only in Southeast Florida but will have an expansion to Orlando. In the first summer of operation of this higher-speed rail line, 15 people were killed and ten more were seriously injured.

A 2019 article in the Miami New Times says that there were 76 fatalities in South Florida railroad incidents, an all-time high for the state.

How Do These Incidents Occur?

The Federal Railroad Administration says that approximately 2,100 railroad crossing accidents occur each year in the US and they affect vehicle passengers, pedestrians, bicyclists, and more. They say that when a train and vehicle collide, the chances of a fatality are 20 times greater than in a vehicle versus vehicle collision. There are various causes of these accidents, including:

No warning signs installed. Many railroad crossings do not have warning signals such as flashing lights or crossing arms. Without these signals to alert drivers of an oncoming train, an accident is more likely to occur.

Faulty warning signs. There are times when installed warning signs are not properly maintained and do not work properly. Defective warning signs will not warn drivers of an oncoming train.

Defects on the track. If a railroad track is damaged or broken, cars could have trouble getting through the crossing. Track defects can also cause the train to derail, leading to danger to anyone around the train.

Steep or uneven roadway. If a roadway leading to the railroad is too steep, a vehicle may not be able to get through the crossing safely. Federal guidelines regulate how steep the road can be leading up to the track.

Obstructed line of sight. There could be various reasons a person’s line of sight could be impeded, including overgrown trees or shrubs, discarded refuse, and more.

Train operator error. If a train operator is not following proper protocols for the area they are operating in, they can cause serious railroad crossing accidents. Train operators could be impaired, distracted, speeding, and more.

Defective train parts. All trains should be regularly inspected and maintained so they remain in good working order. A train part malfunction could lead to serious collisions. For example, brake failure could lead to a train not being able to stop before impacting a vehicle.

There are various parties that can be held accountable for train crashes. This can include:

The train operator

The railroad company

The railroad track owner

The train manufacturer

Government agencies that are responsible for track maintenance

If you are a parent in Florida, the safety of your child is vitally important. Choosing the right child seat for your child is not only important, but it is the law.

When we look nationally, the Centers for Disease Control (CDC) says that during their latest reporting year, there were 723 children 12 and under that died in vehicle crashes. 128,000 children were injured in vehicle crashes.

The CDC says that in one year they studied, more than 618,000 children ages 0-12 rode in vehicles without a child safety seat or booster seat.

Closer to home, there were 130,114 children in vehicle crashes in Florida in 2018. Out of those, there were:

18,579 possible injuries

1,247 serious bodily injuries

155 fatalities

Child Safety Seats Matter

Choosing the right safety seat depends on a variety of factors that we want to discuss with you today. Here are three different types of car seats available to accommodate children in various developmental levels. This is important because child safety seats are not one size fits all.

Infant car seats are different than other child safety seats because they are designed to be rear-facing. This may seem strange, but it is important because rear-facing seats protect newborns and infant children’s heads, necks, and spine by ensuring the force of an impact crosses along with the shell of the car seat. Children at this stage of development do not have the physical ability to withstand the forces of a crash. Never turn a child’s seat to face forward too early. Doing so can result in the significant spine, neck, or brain injuries to the child.

Convertible car seats are ones that are made to transition from rear-facing seats for little infants to forward-facing seats when the child has exceeded the height and weight limits for a rear-facing seat. This is the seat they will be in the longest, so be sure to get one that is comfortable and well-built.

Booster seats are the next step up when your child has outgrown the convertible car seat, but their knees do not yet bend at the edge of the regular backseat cushion when they are sitting all the way back in the seat.

Proper Installation Is Just as Important

You can have the right child safety seat chosen, but if it is not properly installed, your child can still sustain severe injuries. Did you know that a properly installed car seat decreases a child’s risk of injury or death by as much as 70%?

Follow the instructions that come with your child’s safety seat and then have a certified professional check to make sure it is done correctly. You can usually find a certified car seat technician at your local fire or police department.

If You Have Multiple Children

It is recommended to put a child safety seat in the middle of the back seat, but that is not possible if you have more than one kid. Always place the most vulnerable child, usually the youngest, in the center of the vehicle.

Check for Recalls

Child safety seats are commonly recalled items. When a child safety seat is defective and under recall, it will show up on the government website that tracks all recalled safety seats in the US. Check there regularly for dangerous products that could affect your children.
