Tragic Miami Gardens Shooting Ends in Fatal Crash

Michael T. Flanagan, Esq.

A heartbreaking and violent incident in Miami Gardens has left one man dead and a woman critically injured, following a shooting that ended with a vehicle crashing into a townhome in the Mallorca Isles neighborhood. The tragedy occurred just after 12:30 a.m. Friday, when a white Range Rover plowed through a gate and struck a residence near NW 13th Court and 214th Street.

Surveillance footage captured the terrifying moment the vehicle slammed into the fence and trees outside a townhome. According to Miami Gardens Police, the driver — 28-year-old Demonte Lumpkin — was fleeing a shooting that occurred near NW 14th Place when he lost control of the vehicle and crashed.

Lumpkin was shot in the chest and later died at the hospital. His passenger, a woman whose identity has not been released, was also shot multiple times and remains hospitalized in critical condition.

Witnesses at the scene described a chaotic and emotional scene. One neighbor said the vehicle appeared to have two occupants — one was able to exit on their own, while the other had to be rescued from the wreckage. Trees were toppled, and the home’s front gate was destroyed.

This is still an active investigation. Authorities are urging anyone with information to come forward. Miami-Dade Crime Stoppers is offering a reward of up to $5,000 for tips leading to an arrest. Calls can be made anonymously to 305-471-TIPS.

Demonte Lumpkin’s mother, Sheena Moorer, gave an emotional interview to local media, pleading for justice and expressing her grief over the senseless loss of her son.

“What a bond you broke when you took my son’s life,” she said. “Now I have to go and visit a grave to see my son, my baby, and I’m not going to sleep until they get you.”

What Rights Do Victims and Families Have After a Crime Like This?

While the criminal investigation focuses on identifying and prosecuting the shooter, the surviving passenger and the family of Demonte Lumpkin may have civil legal options available under Florida law.

Wrongful Death Lawsuit

Under The Florida Wrongful Death Act, the family of a deceased individual may file a wrongful death lawsuit if the death was caused by another party’s intentional act, negligence, or recklessness — including acts of gun violence.

Even if the perpetrator is not immediately identified, victims’ families may still pursue:

  • Civil lawsuits against third parties (such as a negligent property owner who failed to provide adequate security),
  • Claims through the deceased’s auto or life insurance,

Personal Injury Claims for Surviving Victims

The passenger who survived may have grounds for a personal injury lawsuit, depending on the circumstances. If the shooter is apprehended, they may be civilly liable for:

  • Medical bills,
  • Pain and suffering,
  • Permanent injuries or disfigurement,
  • Lost wages, and
  • Emotional trauma.

Additionally, if the townhome complex or surrounding property failed to provide adequate security in an area with a history of violence, a negligent security claim may be possible.
