Fatal Hit-and-Run: Man in Wheelchair Struck and Killed in Orange County, Florida

Michael T. Flanagan, Esq.

A heartbreaking hit-and-run incident in Orange County has claimed the life of a 48-year-old Casselberry man who was struck while traveling in his wheelchair on State Road 436 Sunday night. Florida Highway Patrol (FHP) is now actively seeking the driver responsible.

The fatal collision occurred around 9:00 p.m. on State Road 436 near State Road 50, just east of downtown Orlando. According to the FHP, the man was crossing S.R. 436 in a wheelchair and was not in a designated crosswalk when he was struck by a dark-colored sedan traveling southbound. Witnesses described the vehicle as fleeing the scene immediately after the crash.

Emergency responders arrived on the scene and transported the victim to a local hospital, where he was pronounced deceased. His identity has not yet been released pending notification of next of kin.

This tragedy highlights the dangers pedestrians and mobility-impaired individuals face on Florida roadways, especially in areas lacking accessible crosswalks or sufficient lighting. Authorities are urging the public to come forward with any information that may help identify the driver. Tips can be submitted by calling *FHP at 347 or Crimeline at 800-423-TIPS. All tips can be provided anonymously.

The Florida Highway Patrol continues to investigate and is reviewing any available surveillance footage in the area.

When a driver leaves the scene of a fatal accident, they not only violate criminal laws but also open themselves up to significant civil liability. In situations like this, where a vulnerable pedestrian or mobility device user is struck, surviving family members may pursue a wrongful death lawsuit.

Legal claims may include compensation for:

  • Funeral and burial costs
  • Loss of companionship or financial support
  • Pain and suffering endured by the family
  • Punitive damages in cases involving gross negligence or intentional disregard for human life

If the responsible driver is located, they may face criminal charges in addition to a civil lawsuit for wrongful death and personal injury damages.

This case also underscores the urgent need for improved infrastructure and safety protocols for individuals with disabilities. Wheelchair users are among the most vulnerable road users and deserve the same protections and accommodations as all pedestrians. Public agencies and municipalities may also be held liable in some cases if a lack of safe crossings or poorly maintained roadways contributed to the crash.
