Fatal Head-On Collision in Volusia County Leaves One Dead and Two Seriously Injured
A tragic head-on collision late Saturday night on State Road 40 has resulted in the death of a motorcyclist and left two ATV riders seriously injured, according to the Florida Highway Patrol (FHP). The crash occurred around 11:50 p.m. near the intersection of Pine Woods Road.
A 35-year-old man from Ormond Beach was riding his motorcycle eastbound when an ATV, driven by a 28-year-old woman with a 22-year-old passenger, entered his path, resulting in a severe head-on crash. The ATV was reportedly traveling westbound along the eastbound right grass shoulder before entering the eastbound lane, leading directly into the motorcyclist’s path.
Tragically, the motorcyclist was pronounced dead at the scene. The two occupants of the ATV were hospitalized with serious injuries. It was noted by FHP that the motorcyclist was the only person wearing a helmet at the time of the crash.
The Florida Highway Patrol is actively investigating the circumstances that led to the ATV crossing into the motorcycle’s lane. The cause of the incident is currently undetermined, with factors such as speed, distraction, or road conditions potentially under review.
Legal Options Following a Collision
Incidents like this raise critical legal questions for victims and their families regarding compensation, liability, and justice. If you or a loved one has been affected by a crash involving motorcycles, ATVs, or other vehicles, understanding your legal options is essential.
Potential Claims:
- Wrongful Death Claims: Families of the deceased motorcyclist may pursue wrongful death claims seeking damages for funeral expenses, loss of financial support, emotional pain and suffering, and loss of companionship.
- Personal Injury Claims: Injured ATV riders may be entitled to compensation for medical expenses, rehabilitation costs, lost wages, pain and suffering, and future care needs.
- Product Liability: In certain cases, if vehicle malfunction or defective equipment contributed to the crash, manufacturers could be held accountable under product liability laws.
Investigations often focus on establishing fault, which can involve driver negligence, failure to follow traffic laws, or unsafe operation of vehicles. The presence or absence of protective gear like helmets may also be relevant in evaluating contributory negligence.
Navigating the aftermath of a serious crash involves complex legal processes and dealing with insurance companies that may attempt to minimize payouts. Experienced personal injury and wrongful death attorneys can provide invaluable assistance in:
- Thoroughly investigating the accident
- Collecting and preserving evidence
- Consulting expert witnesses
- Negotiating with insurers

The loss of life and serious injuries from this collision underscore the dangers of roadways and the importance of cautious driving and proper safety measures. Families affected by such tragedies deserve compassionate legal support to ensure their rights are protected and that they receive just compensation for their suffering.
