Man Hospitalized After Scooter Crash in Miami: Growing Concerns About Bike and Scooter Safety in South Florida

Michael T. Flanagan, Esq.

A 28-year-old man was hospitalized in serious condition early Sunday morning after being struck by a car while riding a scooter in Miami, according to Miami-Dade Fire Rescue. The crash highlights the growing dangers for scooter and bicycle riders in South Florida, where collisions involving two-wheeled vehicles have been rising sharply.

The collision occurred near 1600 NW 7th Avenue in Miami. Emergency responders found the man with serious injuries and transported him to Jackson Memorial Hospital. Video obtained by CBS News Miami showed the scooter’s back wheel jammed under the front of the car, demonstrating the violent impact of the collision.

Authorities have not yet released further details about the cause of the crash, and Miami police continue to investigate.

This latest incident is not isolated. South Florida has seen a troubling increase in scooter and bicycle accidents over the past year:

These tragic crashes demonstrate both the vulnerability of riders and the complex legal issues that arise when scooters, e-bikes, and cars share busy roadways.

Under Florida law, scooter riders have many of the same rights and responsibilities as bicyclists. That means drivers must yield the right of way when appropriate, avoid unsafe maneuvers, and exercise caution to prevent collisions.

In scooter-related accidents, liability may depend on:

  • Driver Negligence: If the motorist was distracted, speeding, or failed to yield, they may be held responsible.
  • Improper Use of Scooters: If riders are operating scooters on prohibited roadways (such as highways), they could share partial fault under Florida’s modified comparative negligence statute.
  • Roadway Design or Maintenance Issues: Dangerous intersections, poor signage, or lack of designated bike lanes can contribute to crashes, raising potential claims against municipalities.
  • Product Liability: If the scooter itself was defective — such as brake failure — manufacturers may share responsibility.

For injured riders, a personal injury claim may allow recovery of damages including medical expenses, lost wages, pain and suffering, and long-term rehabilitation costs.

Scooter riders face unique risks compared to car occupants due to:

  • Lack of Protection: Unlike cars, scooters offer no barriers to absorb impact.
  • Visibility Issues: Scooters are smaller and harder for drivers to see, especially at night.
  • Road Conditions: Potholes, uneven pavement, and debris pose significant dangers.
  • Speed Differentials: Scooters traveling alongside faster-moving cars increase the risk of serious injury in crashes.

Despite these risks, scooters remain popular due to their affordability and convenience, making it critical for both riders and drivers to take extra precautions.
