A suspect has been arrested in connection with a fatal hit-and-run crash that claimed the life of a 40-year-old woman in Leesburg, Florida, according to local authorities. The incident occurred along U.S. 27 and has raised renewed concerns about pedestrian safety on high-speed roadways.

What We Know About the Crash

According to the Leesburg Police Department, the crash occurred on April 10, 2026, along U.S. 27 south of Singletary Park. Investigators say 40-year-old Ashleah Hayes was crossing the highway when she was struck by a gray Hyundai sedan traveling northbound.

Authorities say the driver fled the scene following the collision, leaving Hayes critically injured. She was pronounced dead at the scene.

After an investigation, police identified and arrested 29-year-old Evan Garcia of Ocklawaha. He has been charged with leaving the scene of a crash involving death and was booked into the Marion County Jail. The investigation remains ongoing.

The Dangers of Pedestrian Accidents on Highways

Pedestrian crashes on major roadways like U.S. 27 are often fatal due to high speeds and limited crossing opportunities.

Key risk factors include:

Vehicles traveling at highway speeds

Limited visibility, especially at night or in poorly lit areas

Lack of designated crosswalks or pedestrian signals

Drivers failing to anticipate pedestrians

When a driver leaves the scene, the danger is compounded by delays in emergency response and medical care.

Legal Consequences of Hit-and-Run Crashes in Florida

Florida law requires drivers involved in crashes resulting in injury or death to stop, remain at the scene, and render aid.

Failure to do so can result in serious criminal penalties, including:

Felony charges for leaving the scene of a crash involving death

Potential prison time and fines

Additional charges depending on the circumstances

In addition to criminal consequences, drivers may face significant civil liability.

Wrongful Death Claims Under Florida Law

Under Florida’s Wrongful Death Act, Florida Statutes §§ 768.16–768.26, surviving family members may be entitled to pursue compensation if negligence contributed to the crash.

Damages may include:

Funeral and burial expenses

Medical expenses related to the incident

Loss of financial support and services

Loss of companionship and protection

Mental pain and suffering

Even in hit-and-run cases, compensation may be available through insurance policies or other legal avenues.

Investigation Ongoing

The Leesburg Police Department continues to investigate the circumstances of the crash and the actions of the driver.

Our Thoughts Are With the Family

Our thoughts are with Ashleah Hayes’ family and loved ones during this tragic time.

A tragic pedestrian accident in Lake Worth Beach has resulted in the death of a 31-year-old woman who was struck by a vehicle just steps from her apartment. According to the Palm Beach County Sheriff’s Office, the crash occurred on March 23, 2026, shortly before 8:00 p.m. on Lucerne Avenue near Lakeside Drive. The victim was transported to a local hospital but later died from her injuries.

What We Know About the Incident

The crash occurred on Lucerne Avenue near Lakeside Drive in Lake Worth Beach, Florida

The incident took place shortly before 8:00 p.m. on March 23, 2026

The victim was a 31-year-old woman from Lake Worth Beach

The woman was crossing the roadway from south to north

The crossing occurred outside of a marked crosswalk

A Hyundai Genesis was traveling westbound in the outside lane

The vehicle struck the pedestrian, causing her to be thrown onto the roadway

The victim was transported to St. Mary’s Medical Center

She later died from her injuries at approximately 9:04 p.m.

The Palm Beach County Sheriff’s Office is investigating the crash

Risks and Safety Concerns

Pedestrian accidents are among the most severe types of traffic incidents, often resulting in catastrophic or fatal injuries due to the lack of protection for individuals on foot. Even at moderate speeds, the force of impact from a vehicle can cause life-threatening trauma.

Roadways like Lucerne Avenue can present heightened risks, particularly at night when visibility is reduced. Pedestrians crossing outside of designated crosswalks may be more difficult for drivers to anticipate, especially if lighting conditions are poor or traffic is moving at higher speeds.

However, drivers also have a responsibility to remain vigilant and operate their vehicles safely, particularly in residential areas where pedestrian activity is common. Failure to maintain a proper lookout or adjust speed can contribute to these types of incidents.

Legal Options and Potential Liability

Pedestrian fatalities often involve complex questions of liability, especially when the individual was not in a marked crosswalk. Under Florida law, both drivers and pedestrians have duties to act with reasonable care, and liability may be shared depending on the circumstances.

Potential liable parties may include:

Negligent driver: A driver who fails to maintain a proper lookout, drives at an unsafe speed, or is distracted may be held liable for striking a pedestrian, even if the pedestrian was outside a crosswalk.

Vehicle owner: Under Florida’s dangerous instrumentality doctrine, the owner of the vehicle may be held responsible for damages caused by the driver.

Government entities: If poor lighting, lack of pedestrian crossings, inadequate signage, or unsafe roadway design contributed to the crash, the agency responsible for maintaining the roadway may share liability.

Third parties: In some cases, nearby property conditions, obstructions, or construction activity may contribute to reduced visibility and may be evaluated for potential liability.

Under Florida’s comparative negligence system, fault may be apportioned among multiple parties based on their level of responsibility. Even if a pedestrian is partially at fault, recovery may still be possible depending on the circumstances.

In fatal pedestrian accident cases, surviving family members may pursue a wrongful death claim and recover compensation for:

Medical expenses incurred prior to death

Funeral and burial costs

Loss of financial support and future earnings

Loss of companionship and emotional suffering

These claims are typically brought by the personal representative of the estate on behalf of eligible survivors.

Investigation Ongoing

The Palm Beach County Sheriff’s Office continues to investigate the crash and determine the circumstances that led to the collision. Authorities are expected to review traffic conditions, lighting, vehicle speed, and witness statements to establish liability.

If you or a loved one was involved in a similar accident, contact Flanagan & Bodenheimer Injury and Wrongful Death Law Firm for a free consultation to discuss your legal options.

An 87-year-old Boca Raton man has died days after being struck by a vehicle in a parking lot crash at a Costco store, according to the Palm Beach County Sheriff’s Office.

The incident occurred around 4:33 p.m. on March 9 in the parking lot of the Costco Wholesale located at 17800 South Congress Avenue in Boca Raton, Florida.

Authorities say the pedestrian later died from injuries sustained in the crash.

According to investigators, a 2013 Lexus RX 350 was traveling southwest through the Costco parking lot when the driver attempted to make a left turn.

Deputies say the driver failed to yield to a pedestrian who was walking toward the entrance of the store. The front left bumper of the SUV struck the pedestrian, knocking him to the pavement.

The victim was identified as 87-year-old Maurice Kofman of Boca Raton.

Emergency responders transported Kofman to Delray Medical Center with critical injuries following the crash. Authorities later confirmed that he died from his injuries on March 15 at approximately 5:14 p.m.

Family members have been notified.

Investigators say the driver of the vehicle, a 54-year-old woman from Boca Raton, was not injured in the crash. Authorities reported that she was wearing a seatbelt at the time of the incident.

According to the sheriff’s office, alcohol or drugs are not suspected as factors in the crash. Officials have not yet announced whether any charges will be filed.

The investigation into the incident remains ongoing.

Pedestrian accidents in parking lots

Although parking lots are typically associated with slower vehicle speeds, pedestrian crashes still occur frequently in these areas. Large retail parking lots often have heavy foot traffic combined with vehicles moving through narrow lanes, reversing out of spaces, or turning toward store entrances.

Drivers navigating crowded parking lots may become distracted by other vehicles, pedestrians, or parking availability. When drivers fail to properly check their surroundings or yield to pedestrians, serious injuries can occur even at relatively low speeds.

Older pedestrians may be especially vulnerable to severe injuries in these situations because falls and blunt force trauma can lead to life-threatening complications.

Legal options and potential liability

When a pedestrian is struck by a vehicle, investigators evaluate whether the driver exercised reasonable care and followed traffic laws governing right-of-way. Drivers have a duty to remain alert and yield to pedestrians, particularly in areas where foot traffic is expected, such as store entrances and parking lots.

If a driver fails to yield or otherwise acts negligently, they may be held legally responsible for injuries or fatalities resulting from the crash.

Potential liability in pedestrian accidents may involve:

Drivers who fail to yield to pedestrians

Distracted or careless driving in parking lots

Property owners who fail to maintain safe pedestrian pathways

Poor signage or dangerous traffic flow patterns in commercial parking areas

When a fatal crash occurs, surviving family members may have the right to pursue a wrongful death claim under Florida law. These claims can help families recover compensation for medical expenses, funeral costs, loss of companionship, and other damages associated with the loss of a loved one.

Investigation ongoing

The Palm Beach County Sheriff’s Office continues to investigate the crash that occurred in the Costco parking lot on South Congress Avenue in Boca Raton. Authorities have not yet announced whether any citations or charges will be issued.

Pedestrian crashes can have devastating consequences for families and communities. When a fatal accident occurs, understanding the circumstances surrounding the crash is critical to determining whether negligence played a role.

A fatal crash involving a pedestrian caused major traffic disruptions early Friday morning on Interstate 95 in Palm Beach County, according to the Florida Highway Patrol.

The crash occurred shortly after 3:00 a.m. on March 13, 2026, on northbound Interstate 95 just before the 10th Avenue North exit in Lake Worth Beach.

Authorities say the incident involved a pedestrian who was struck by multiple vehicles.

According to investigators, the pedestrian was walking in the outside center lane of northbound I-95 when she was struck by a vehicle.

Officials say the driver who initially hit the pedestrian continued northbound without stopping.

After the initial impact, the victim was run over by additional vehicles traveling on the highway, authorities said.

An independent witness reported seeing a small four-door sedan strike the pedestrian, though investigators have not yet confirmed the vehicle involved.

At the scene, authorities were unable to immediately identify the victim.

Officials described the victim as a Black female, and her identity is currently being determined through fingerprint analysis by the Palm Beach County Medical Examiner’s Office.

Authorities have not yet released additional details about the victim.

Because of the severity of the crash and the need for a detailed investigation, all northbound lanes of Interstate 95 were shut down for several hours.

The closure caused significant traffic delays throughout the area.

Officials reported that traffic backups stretched as far back as the Lantana Road exit.

The roadway was reopened around 7:15 a.m., more than four hours after the crash occurred.

Pedestrian Risks on High-Speed Highways

Pedestrians on interstate highways face extremely high risks due to the speed of traffic and limited visibility for drivers.

Vehicles traveling at highway speeds often have very little time to react to pedestrians in the roadway, especially during nighttime hours.

Pedestrian crashes on highways may occur due to:

Vehicle breakdowns or roadside emergencies

Impaired or distracted pedestrians

Drivers failing to see individuals in the roadway

Poor visibility or lighting conditions

Hit-and-run incidents

These crashes are frequently catastrophic due to the speed and volume of traffic.

Legal Considerations in Hit-and-Run Pedestrian Crashes

When a driver strikes a pedestrian and leaves the scene, it can lead to serious criminal and civil liability.

Under Florida law, drivers involved in crashes resulting in injury or death must:

Stop immediately at the scene

Provide assistance to injured individuals

Contact law enforcement

Failing to stop after a crash involving death is a serious felony offense.

In addition to criminal charges, families of victims may be able to pursue wrongful death claims if negligence contributed to the crash.

Investigation Ongoing

The Florida Highway Patrol continues to investigate the fatal pedestrian crash on northbound Interstate 95 near the 10th Avenue North exit in Lake Worth Beach.

Authorities are still working to identify the victim and determine the vehicle involved in the initial collision.

Anyone with information about the crash is encouraged to contact law enforcement.

If your family has lost a loved one in a pedestrian accident or hit-and-run crash, speaking with an experienced attorney can help you understand your legal rights and options.

A man was killed early Tuesday morning after falling from a skateboard and being struck by a vehicle on a busy Fort Lauderdale roadway, according to the Fort Lauderdale Police Department.

The fatal incident occurred shortly before 4:00 a.m. on March 10 near the intersection of State Road A1A and Sunrise Boulevard.

Authorities say the crash remains under investigation and the driver involved has not yet been located.

According to investigators, a 40-year-old man who lived in the area was riding a skateboard near A1A and Sunrise Boulevard early Tuesday morning.

Police say the man fell off the skateboard and landed in the roadway.

Moments later, a passing vehicle struck the man while he was lying in the street.

Emergency responders arrived at the scene, but the victim did not survive his injuries.

Authorities have not yet publicly released the victim’s name.

Investigators say they are still attempting to locate the driver of the vehicle involved in the crash.

At this time, police say it is unclear whether the incident will ultimately be classified as a hit-and-run.

Anyone with information about the crash has been asked to contact Broward Crime Stoppers.

Following the crash, northbound lanes of State Road A1A were shut down as police and investigators processed the scene.

Video footage from the area showed a tarp covering the victim and a skateboard lying near the roadway as investigators documented the crash.

The roadway has since reopened to traffic.

Pedestrian Risks on Major Roadways

Roadways such as A1A often experience heavy vehicle traffic, even during early morning hours.

Individuals on foot or using skateboards are particularly vulnerable in these environments because drivers may not expect them in travel lanes.

Factors that often contribute to fatal pedestrian crashes include:

Low visibility at night or early morning

Limited lighting along roadways

Driver distraction

Speeding

Pedestrians unexpectedly entering the roadway

When someone falls or becomes incapacitated in traffic lanes, the risk of a fatal collision increases significantly.

Potential Legal Considerations After Pedestrian Crashes

Fatal pedestrian crashes can involve complex legal questions regarding liability and driver responsibility.

Investigators may examine:

Vehicle speeds and braking evidence

Traffic camera or surveillance footage

Roadway lighting conditions

Witness statements

Whether the driver attempted to stop or render aid

Even when a pedestrian unexpectedly enters the roadway, drivers may still have legal responsibilities to avoid collisions when possible and remain at the scene of a crash.

In fatal cases, surviving family members may have the right to pursue a wrongful death claim if negligence contributed to the incident.

Investigation Ongoing

The Fort Lauderdale Police Department continues to investigate the fatal crash involving a skateboarder on State Road A1A near Sunrise Boulevard.

Authorities are working to determine the full circumstances surrounding the incident and locate the driver involved.

A pedestrian was killed and two others were injured Wednesday afternoon after being struck by a pickup truck near the busy Sawgrass Mills shopping district in Sunrise, according to local authorities.

The crash occurred shortly before 1:45 p.m. at the intersection of West Sunrise Boulevard and Yellow Toucan Road, just east of Northwest 136th Avenue near Sawgrass Mills.

According to the Sunrise Police Department, a group of pedestrians was crossing the roadway when they were struck by a vehicle believed to be a pickup truck.

Surveillance video from the area reportedly captured the moment several people were crossing the street before the truck hit them.

Emergency responders arrived at the scene and found three injured pedestrians.

One of the victims was pronounced dead at the scene.

The other two individuals were transported to a nearby hospital for treatment. Authorities have not yet released their conditions.

Aerial footage from the scene showed the roadway closed off with police tape and a body covered with a tarp near the truck involved in the crash.

The crash remains under investigation.

Intersections surrounding major shopping centers like Sawgrass Mills can present serious safety risks for pedestrians due to heavy traffic and frequent vehicle turning movements.

Common factors in pedestrian crashes near commercial corridors include:

Drivers failing to yield at crosswalks

Speeding or distracted driving

High pedestrian traffic near retail entrances

Drivers navigating busy parking areas and intersections

Investigators will likely review surveillance footage, traffic signals, and witness statements to determine exactly how the crash occurred.

Legal Considerations in Pedestrian Injury and Fatality Cases

Under Florida law, drivers must exercise reasonable care to avoid striking pedestrians, particularly when individuals are crossing the roadway at intersections or designated crossings.

When a driver fails to yield or is otherwise negligent, they may be held liable for injuries or fatalities resulting from the crash.

Victims injured in pedestrian accidents may be entitled to compensation for:

Emergency medical treatment

Hospitalization and rehabilitation

Lost wages and future earning capacity

Pain and suffering

In fatal cases, surviving family members may pursue a wrongful death claim, which can include damages for funeral expenses, loss of companionship, and emotional suffering.

Because this crash occurred in a busy commercial district with surveillance cameras, investigators may use video evidence and accident reconstruction to determine liability.

Police continue to investigate the fatal pedestrian crash at West Sunrise Boulevard and Yellow Toucan Road near Sawgrass Mills.

A 68-year-old Cocoa man was killed late Tuesday night after being struck by a vehicle while walking along State Road 520, according to the Florida Highway Patrol.

The fatal crash occurred around 11:50 p.m. on February 3 near the intersection of State Road 520 and Clearlake Road.

According to troopers, a 2006 Chevrolet Express truck was traveling westbound on State Road 520 when the pedestrian, who had been walking along the north shoulder of the roadway, entered the vehicle’s path.

Investigators say the pedestrian crossed into the direct path of the truck, resulting in a collision.

The 68-year-old man was pronounced dead at the scene. The driver of the truck, a 38-year-old man, was not injured. The crash remains under investigation.

Pedestrian crashes frequently occur on high-speed roads such as State Road 520, particularly during nighttime hours when visibility is reduced.

Factors that often contribute to pedestrian accidents include:

Poor lighting conditions

Limited shoulder space or sidewalks

Drivers traveling at highway speeds

Difficulty seeing pedestrians crossing or walking near the roadway

Even when drivers attempt to react, high speeds can make it difficult to avoid a collision once a pedestrian enters the roadway.

Legal Considerations in Pedestrian Fatalities

Fatal pedestrian crashes often require careful investigation to determine whether negligence contributed to the incident.

Investigators may examine:

Vehicle speed and braking patterns

Roadway lighting conditions

Driver attentiveness or distraction

Whether the pedestrian had a safe place to walk

Whether roadway design created dangerous conditions

Under Florida law, both drivers and pedestrians have responsibilities when sharing the roadway. Determining liability often requires reviewing witness statements, crash reconstruction evidence, and surveillance footage when available.

In fatal accidents, surviving family members may have the right to pursue a wrongful death claim, which can help recover damages for:

Funeral and burial expenses

Medical costs incurred prior to death

Loss of financial support

Loss of companionship

Emotional pain and suffering

A 19-year-old college student was hospitalized with life-threatening injuries after being struck by a box truck on a Gainesville campus Monday morning, according to the Gainesville Police Department.

The crash occurred shortly after 10:30 a.m. on Buckman Drive near Buckman Hall, temporarily shutting down part of the roadway as officers and emergency responders worked the scene.

Authorities say the crash involved a female pedestrian and a box truck associated with a local Hare Krishna organization that provides campus lunch services.

Witnesses reported that the student was stepping toward a sidewalk near a crosswalk when she was struck by the truck. Emergency responders transported her to a nearby hospital with life-threatening injuries, officials confirmed.

Police later identified the victim as a 19-year-old student. As of the latest update, no additional information has been released regarding her condition.

The Gainesville Police Department is treating the incident as a traffic homicide investigation, a standard procedure for crashes involving fatal or life-threatening injuries to determine contributing factors and potential liability.

A representative from the Hare Krishna organization confirmed the box truck involved belongs to the group. The organization temporarily paused its campus lunch service following the crash, stating that members are deeply shaken by the incident.

According to the representative, the organization is praying for the student’s recovery and cooperating with authorities as the investigation continues.

Ongoing Investigation

At this time, investigators have not announced whether any charges will be filed. Under Florida law, traffic crash reports are typically unavailable to the public for 60 days unless requested by an involved party, meaning additional details may not be released immediately.

Authorities will review evidence including:

Witness statements

Scene evidence

Vehicle positioning and movement

Surveillance or nearby video footage

Driver and pedestrian actions prior to impact

These investigations help determine whether the crash was the result of driver negligence, roadway conditions, visibility issues, or other contributing factors.

Pedestrian Safety Concerns on Campus

Pedestrian-vehicle collisions on or near college campuses can be especially severe due to heavy foot traffic and delivery vehicles operating in tight spaces. Even low-speed collisions involving trucks or commercial vehicles can result in catastrophic injuries due to their size and limited visibility.

Common factors in pedestrian crashes include:

Failure to yield at crosswalks

Distracted driving

Limited driver visibility around large vehicles

Poor lighting or obstructed views

Speeding in pedestrian-heavy areas

Legal Options After a Serious Pedestrian Accident

When a pedestrian is seriously injured in a vehicle collision, an investigation may reveal whether negligence played a role. Depending on the circumstances, liability could involve:

The vehicle driver

An employer or organization operating the vehicle

A commercial insurance policy

Third parties responsible for roadway design or safety

Victims and families may be entitled to compensation for medical expenses, long-term care needs, lost income, and pain and suffering.

Speeding or reckless driving

Distracted driving

Driver fatigue

Impaired driving

Loss of vehicle control

Failure to maintain lane or roadway awareness

When a vehicle leaves the roadway or veers into a designated pedestrian area, the resulting injuries can be catastrophic due to the lack of protection for pedestrians.

Who May Be Liable in a Pedestrian Crash?

Liability in a pedestrian accident depends on the specific facts of the crash. Potentially responsible parties may include:

Negligent drivers

Employers if the driver was working at the time of the crash

Vehicle owners

Government entities if dangerous roadway conditions contributed

Vehicle manufacturers in cases involving mechanical failure

Investigators typically review surveillance footage, crash reconstruction evidence, and witness statements to determine how and why the incident occurred.

Compensation Available for Injured Pedestrians

Pedestrians who suffer serious injuries in vehicle crashes may be entitled to pursue compensation for:

Emergency medical treatment

Surgeries and hospitalization

Rehabilitation and long-term care

Lost income and reduced earning ability

Pain and suffering

Emotional trauma

Because pedestrian injuries are often severe, these cases frequently involve significant long-term medical needs and financial losses.

Importance of an Independent Investigation

Law enforcement focuses on determining what happened and whether traffic laws were violated. However, a separate legal investigation may be necessary to evaluate civil liability and secure compensation for injured victims.

An independent investigation may include:

Reviewing surveillance or traffic camera footage

Analyzing crash reconstruction evidence

Examining driver behavior and phone records

Identifying insurance coverage

Interviewing witnesses

A 64-year-old Sarasota man was killed Tuesday morning after being struck by a tractor-trailer on Interstate 75 in Sarasota County, according to the Florida Highway Patrol (FHP).

The crash occurred at approximately 8:55 a.m. in the southbound lanes of I-75 near Mile Marker 202, about three miles south of Clark Road (Exit 205).

According to FHP:

A 56-year-old Minnesota man was driving a 1999 Peterbilt tractor cab and trailer southbound in the right travel lane.

The pedestrian had parked his vehicle on the paved shoulder near Mile Marker 202.

Troopers say the pedestrian was standing near his vehicle before stepping into the travel lane.

The front right corner of the tractor-trailer struck the pedestrian.

Sarasota County EMS pronounced the 64-year-old man deceased at the scene.

The Florida Highway Patrol’s Traffic Homicide Unit is actively investigating the crash.

Pedestrian incidents on interstate highways are especially dangerous due to:

High vehicle speeds

Limited driver reaction time

Reduced visibility

Heavy commercial vehicle traffic

When a vehicle is disabled or stopped on the shoulder of an interstate, even brief exposure to active lanes of traffic can result in catastrophic or fatal outcomes.

When a crash involves a tractor-trailer, investigators may examine:

Driver speed and braking patterns

Commercial vehicle maintenance records

Driver logs and compliance with federal safety regulations

Roadway conditions and visibility

Commercial drivers are subject to both Florida traffic laws and federal motor carrier safety regulations. While initial reports may suggest how a collision occurred, a full investigation is necessary before determining liability.

Under Florida’s modified comparative negligence law (§768.81), fault may be shared among parties depending on the circumstances. In some cases, liability questions may involve:

Driver attentiveness

Whether emergency flashers or warning devices were properly deployed

Road design or shoulder safety conditions

Commercial vehicle safety compliance

Each fatal crash must be evaluated based on the specific facts and available evidence.

Wrongful Death Claims in Florida

When a pedestrian is killed in a traffic crash, surviving family members may have the right to pursue a wrongful death claim if negligence contributed to the incident.

Potential recoverable damages under Florida law may include:

Funeral and burial expenses

Loss of financial support

Loss of companionship and protection

Mental pain and suffering of surviving family members

Medical expenses incurred prior to death

An independent investigation can help determine whether all contributing factors have been properly examined.

The Importance of Early Evidence Preservation

In fatal crashes involving commercial vehicles, evidence can include:

Event data recorder (black box) information

Dash camera footage

Maintenance and inspection logs

Electronic logging device (ELD) records

Surveillance or traffic camera video

Preserving this evidence quickly can be critical to fully understanding what occurred.

A 74-year-old Bradenton man was killed Saturday night after being struck by a vehicle while attempting to cross U.S. 41 in Manatee County, according to the Florida Highway Patrol (FHP).

Troopers say the crash occurred around 9:48 p.m. near U.S. 41/14th Street West and 51st Avenue Drive West. Investigators reported that the pedestrian was crossing the roadway when he was hit by a vehicle traveling southbound.

The man died at the scene. The driver — a 24-year-old woman from Palmetto — was not injured. Authorities say the crash remains under investigation.

Pedestrian collisions occurring after dark are among the most dangerous roadway incidents. Reduced visibility, traffic speed, and roadway design can significantly impact a driver’s ability to detect someone crossing the street.

Common contributing factors in nighttime pedestrian crashes include:

Limited street lighting

Drivers failing to see pedestrians in time

Pedestrians crossing outside designated crosswalks

Speed and reaction time

Driver distraction

Even when a pedestrian is not inside a marked crossing area, drivers still have a duty under Florida law to exercise reasonable care to avoid a collision.

Legal Options After a Fatal Pedestrian Crash in Florida

When a pedestrian crash results in death, surviving family members may have the right to pursue a wrongful death claim under Florida’s Wrongful Death Act (Fla. Stat. §§768.16–768.26) if negligence contributed to the incident.

Potential recoverable damages may include:

Funeral and burial expenses

Medical costs related to emergency response

Loss of financial support

Loss of companionship and protection

Mental pain and suffering of surviving family members

Florida follows a modified comparative negligence system (§768.81), meaning fault may be shared between parties. Even if a pedestrian was crossing outside a designated area, compensation may still be available if a driver failed to act reasonably.

Law enforcement investigates pedestrian fatalities to determine how the crash occurred and whether traffic laws were violated. They do not pursue civil recovery for grieving families.

An independent legal investigation may examine:

Roadway lighting and visibility conditions

Vehicle speed and braking evidence

Crash reconstruction findings

Witness statements

Surveillance or traffic camera footage

Insurance coverage

A missing and endangered Manatee County man was found Wednesday evening after being seriously injured in a crash involving an SUV along an Interstate 75 exit ramp near Sun City, according to the Manatee County Sheriff’s Office and the Florida Highway Patrol.

Authorities identified the injured man as Nathaniel R. Modglin, 37, who had been reported missing from Palmetto earlier in the week. Modglin was last seen Sunday afternoon in the 14440 block of Harlee Road. Surveillance footage later showed him walking north along U.S. 41 in Ruskin Sunday evening.

Family members reported that Modglin had left without his prescribed medication, raising concerns that he may have been disoriented or confused at the time.

According to FHP, the crash occurred around 6:35 p.m. on an I-75 southbound exit ramp leading to State Road 674. A 70-year-old man from Michigan was driving a Buick Encore when Modglin was crossing at the bottom of the ramp and entered the vehicle’s path. The SUV struck Modglin, causing serious injuries.

Emergency responders transported him to a hospital for treatment. His current condition has not been publicly updated.

Pedestrian crashes on interstate ramps are among the most severe traffic incidents due to higher speeds, limited reaction time, and poor visibility. Exit ramps are not designed for pedestrian traffic, yet vulnerable individuals—including those who are missing, disoriented, or experiencing medical or mental health crises—are sometimes exposed to these dangerous areas.

Factors that often contribute to these crashes include:

Limited lighting or visibility on ramps

Driver speed and sightline limitations

Lack of pedestrian barriers or warning systems

Medical or cognitive impairment of the pedestrian

Each of these factors must be carefully examined to determine whether negligence played a role.

Legal Options After a Pedestrian Is Seriously Injured in Florida

Even when a pedestrian enters a roadway unexpectedly, drivers still have a duty to operate their vehicles safely and remain attentive. In serious injury cases, a civil injury claim may still be available depending on the circumstances.

Potential compensation may include:

Medical expenses and future medical care

Rehabilitation and long-term treatment costs

Lost wages and diminished earning capacity

Pain and suffering

Permanent disability or impairment

Additionally, other parties may bear responsibility, such as government entities, if roadway design, lighting, signage, or safety features contributed to the crash.

Law enforcement investigations focus primarily on documenting the crash—not on identifying all possible civil liability. An independent investigation can help uncover:

Vehicle speed and braking data

Lighting and visibility conditions on the ramp

Roadway design or safety deficiencies

Surveillance or traffic camera footage

Witness statements

This information can be critical in determining whether the injured person or their family has a viable legal claim.

A tragic pedestrian crash claimed the life of a 68-year-old man Wednesday night along U.S. 41 near Bayshore Drive in Collier County, according to the Florida Highway Patrol (FHP).

FHP confirmed the deadly crash involved a vehicle traveling southbound on U.S. 41 in the area of Bayshore Road. Investigators say the pedestrian attempted to cross the southbound lanes of U.S. 41 when he was struck by the vehicle.

Emergency responders transported the man to a local hospital, where he later died from his injuries. His identity has not yet been publicly released. The crash remains under active investigation by FHP.

U.S. 41 is a heavily traveled roadway, particularly at night, and pedestrian crashes in this corridor are unfortunately not uncommon.

Pedestrian accidents on highways like U.S. 41 are often severe or fatal due to high vehicle speeds, multiple travel lanes, limited lighting, and insufficient pedestrian crossings. Even when a pedestrian is crossing outside of a marked crosswalk, drivers still have a legal duty to remain attentive and operate their vehicles safely.

Common factors in fatal pedestrian crashes include:

Driver inattention or distraction

Excessive speed

Poor lighting or visibility conditions

Failure to yield or brake in time

Lack of safe pedestrian infrastructure

Determining fault in these cases requires a careful analysis of driver behavior, roadway design, lighting, and visibility at the time of the crash.

Legal Options for the Victim’s Family

When a pedestrian is killed in a traffic crash, surviving family members may be entitled to pursue a wrongful death claim under Florida law—even if no criminal charges are filed.

A wrongful death claim may allow the family to seek compensation for:

Funeral and burial expenses

Medical costs incurred before death

Loss of financial support and future income

Loss of companionship, guidance, and protection

Mental pain and suffering of surviving family members

Liability may rest with the driver, but in some cases can also involve roadway design issues, inadequate lighting, or dangerous traffic patterns that contribute to pedestrian deaths.

Why an Independent Investigation Is Critical

Law enforcement investigations focus primarily on determining whether traffic laws were violated—not on fully identifying civil liability or maximizing compensation for families. An independent legal investigation can uncover additional evidence, including:

Vehicle speed and braking data

Surveillance or traffic camera footage

Witness statements

Roadway lighting, signage, and crossing conditions

This evidence can be essential in determining whether negligence played a role and in holding the appropriate parties accountable.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent families throughout Florida who have lost loved ones in fatal pedestrian accidents. We intentionally limit our caseload so families work directly with experienced wrongful death attorneys—not case managers.

Our firm can help by:

A serious traffic incident left a woman critically injured Tuesday morning after she was struck by a dump truck near PGA National in Palm Beach Gardens, according to local authorities.

Palm Beach Gardens Fire Rescue responded to the scene along Ryder Cup Boulevard on the morning of January 27, 2026, after reports that a pedestrian had been hit by a dump truck. Emergency responders found an adult woman with severe injuries.

She was transported as a trauma patient to St. Mary’s Medical Center in West Palm Beach, where she remains in critical condition, officials said.

Authorities have not yet released details about how the collision occurred, whether the woman was crossing the roadway, or whether the dump truck driver remained at the scene. The incident remains under investigation.

Collisions between pedestrians and large commercial vehicles, such as dump trucks, are frequently devastating due to the vehicle’s size, weight, and limited visibility. Dump trucks often have significant blind spots, particularly on the front and sides, making pedestrians especially vulnerable in construction zones and high-traffic areas.

Common factors in dump truck pedestrian accidents include:

Failure to yield to pedestrians

Driver distraction or inattention

Blind spots and limited sightlines

Speed or unsafe driving conditions

Poorly designed or marked pedestrian crossings

Potential Legal Options for the Injured Victim

When a pedestrian is struck by a commercial vehicle, multiple parties may be legally responsible depending on the circumstances. In addition to the driver, liability may extend to:

The trucking or construction company that owns or operates the dump truck

A government entity responsible for roadway design or traffic control

Third parties involved in traffic management or site safety

If negligence is found, the injured victim may be entitled to compensation for:

Emergency medical care and future treatment

Rehabilitation and long-term care needs

Lost income and reduced earning capacity

Pain and suffering

Permanent disability or disfigurement

Evidence in commercial vehicle accidents can disappear quickly. Dump trucks may be repaired, data may be overwritten, and witness memories can fade. A prompt investigation can help preserve:

Vehicle inspection and maintenance records

Driver logs and employment history

Surveillance or traffic camera footage

Accident reconstruction evidence

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent victims of serious pedestrian and commercial vehicle accidents throughout Florida. Our firm intentionally limits its caseload so clients receive direct access to experienced attorneys, not case managers.

We can:

A serious pedestrian crash forced the closure of all northbound lanes of Interstate 95 in Nassau County near the Florida–Georgia state line on Tuesday morning, according to local authorities.

The crash occurred on I-95 North in Nassau County and involved a pedestrian on the interstate, a location where vehicle speeds are typically high and pedestrian presence is extremely dangerous. Emergency crews responded to the scene, and all northbound lanes were shut down for several hours while first responders worked to treat the victim and investigate the incident.

The Camden County Sheriff’s Office confirmed that one person was airlifted to a Jacksonville hospital due to the severity of their injuries. As of the latest update, the pedestrian’s condition has not been released.

Traffic was heavily impacted, with drivers urged to avoid the area and seek alternate routes. All lanes have since reopened following the completion of the on-scene investigation and roadway cleanup.

Pedestrian crashes on interstates like I-95 are among the most severe types of traffic incidents. Vehicles traveling at highway speeds leave little margin for error, and even a brief impact can result in life-threatening or fatal injuries.

These cases often raise important questions, including:

How and why the pedestrian ended up on the interstate

Whether the driver was speeding, distracted, or failed to react appropriately

Roadway design, lighting, signage, or construction-related hazards

Whether emergency shoulders or barriers were properly maintained

A full investigation by law enforcement is critical to understanding what led to the crash.

Legal Options After a Pedestrian Crash in Florida

When a pedestrian is seriously injured after being struck by a vehicle, Florida law may allow the victim or their family to pursue a personal injury or wrongful death claim, depending on the outcome.

Potential compensation may include:

Emergency medical care and future treatment costs

Lost wages and loss of future earning capacity

Pain and suffering

Long-term disability or rehabilitation expenses

In fatal cases, funeral expenses and loss of companionship and support

Even in complex scenarios involving highways or limited pedestrian access areas, liability is not automatically ruled out. Each case depends on the facts, evidence, and applicable traffic and safety laws.

Evidence in serious pedestrian crashes can disappear quickly. Surveillance footage, dashcam video, vehicle data, and witness statements are often time-sensitive. Early legal involvement can help ensure that critical evidence is preserved and that all responsible parties are identified.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent individuals and families affected by serious pedestrian accidents throughout Florida. Our firm intentionally maintains a small caseload so clients work directly with experienced attorneys who personally handle each case.

We assist by:

Reviewing police reports and roadway conditions

Working with accident reconstruction experts

Identifying all available insurance coverage

Handling all communication with insurers and agencies

A tragic pedestrian crash in Jackson County, Florida, claimed the life of a young man early Saturday morning, according to the Florida Highway Patrol (FHP).

The fatal incident occurred at approximately 12:33 a.m. on State Highway 77, between Graceville and Chipley. FHP reports that a 22-year-old man from Caryville, Florida, was attempting to cross the roadway when he was struck by two separate vehicles traveling in opposite lanes.

One of the vehicles involved was a pickup truck driven by a man from Newton, Alabama. The second vehicle was an SUV driven by a 35-year-old woman from Chipley, who was traveling in the other lane at the time of the collision.

The pedestrian suffered fatal injuries and was pronounced dead at the scene.

Florida Highway Patrol has not released the names of the drivers involved, which is standard practice in many traffic investigations. At this time, no charges have been announced, and troopers have not indicated whether impairment, speed, lighting conditions, or roadway visibility may have played a role.

The crash remains under investigation as authorities work to determine the exact sequence of events and contributing factors.

Fatal pedestrian accidents frequently occur during late-night or early-morning hours, when visibility is reduced and drivers may have limited reaction time. Common contributing factors in pedestrian fatalities include:

Poor roadway lighting

High-speed traffic corridors

Limited crosswalk access

Driver inattention

Pedestrians attempting to cross multi-lane highways

State Highway 77 is a high-speed roadway, and collisions involving pedestrians in these environments often result in catastrophic or fatal injuries.

Legal Options After a Fatal Pedestrian Accident

When a pedestrian is killed in a traffic crash, surviving family members may have the right to pursue a wrongful death claim under Florida law, depending on the circumstances. Even when multiple vehicles are involved, liability may still exist based on factors such as:

Failure to use due care

Speed or failure to reduce speed

Inadequate lighting or roadway design

Failure to avoid a pedestrian when reasonably possible

A full investigation — beyond the initial crash report — is often critical to understanding what truly happened.

Any loss of life on Florida roadways is devastating, particularly when it involves a young person. As the investigation continues, our thoughts remain with the victim’s family and loved ones during this difficult time.

If you or someone you love has questions following a fatal pedestrian crash, speaking with an experienced wrongful death attorney can help clarify rights, options, and next steps while allowing families the space they need to grieve.

A fatal pedestrian crash on Beach Boulevard claimed the life of a 32-year-old man early Sunday morning, according to the Florida Highway Patrol (FHP). Authorities are continuing to investigate the circumstances surrounding the deadly collision.

FHP reports that the crash occurred at approximately 5:45 a.m. on Sunday, January 18, 2026, about half a mile east of Tamaya Boulevard in Jacksonville.

According to troopers, an SUV driven by an 89-year-old Jacksonville man was traveling eastbound in the right lane of Beach Boulevard when it struck a pedestrian who was also in the roadway. The pedestrian, a 32-year-old man from Winter Park, was pronounced dead at the scene.

The driver of the SUV was not injured in the crash.

At this time, authorities have not released the names of those involved, and the investigation remains ongoing.

Pedestrians face extreme risk when struck by vehicles, particularly on high-speed, multi-lane roadways like Beach Boulevard. Even at lower speeds, vehicle-pedestrian collisions frequently result in catastrophic or fatal injuries due to the lack of physical protection.

Common factors investigated in fatal pedestrian crashes include:

Visibility and lighting conditions during early morning hours

Driver reaction time and attentiveness

Vehicle speed

Roadway design and pedestrian access

Whether traffic control devices or crosswalks were present

Potential impairment, distraction, or medical issues

Determining what led to a pedestrian being in the roadway and whether the driver could have avoided the collision is a critical part of these investigations.

Legal Rights After a Fatal Pedestrian Accident in Florida

Under Florida’s Wrongful Death Act, surviving family members may be entitled to pursue a wrongful death claim if negligence played a role in the crash. These cases are not limited to reckless driving and may involve more subtle forms of negligence, such as failure to maintain a proper lookout or unsafe roadway conditions.

Potential compensation may include:

Funeral and burial expenses

Loss of financial support and services

Loss of companionship, care, and protection

Mental pain and suffering

Medical expenses incurred prior to death

In some cases, liability may extend beyond the driver to include government entities responsible for roadway design, lighting, or traffic controls.

At Flanagan & Bodenheimer Injury & Wrongful Death Law Firm, we represent families who have lost loved ones in fatal pedestrian accidents across Florida.

We intentionally maintain a small caseload, allowing families direct access to experienced attorneys—not case managers. Our team promptly works to:

Analyze roadway design, lighting, and traffic patterns

Identify all potential sources of liability and insurance coverage

Handle all communications with insurers and investigators

Families pay nothing upfront. We only recover fees if we recover compensation.

A tragic pedestrian crash claimed a life Friday evening in Bradenton, prompting a major roadway closure and an active investigation by local authorities.

According to the Bradenton Police Department, the fatal crash occurred on Manatee Avenue near the intersection of 21st Street East on Friday evening.

Police announced around 7:30 p.m. that Manatee Avenue would be closed for several hours as investigators worked the scene. Detours were put in place, and drivers were urged to avoid the area if possible.

Details regarding the identity of the pedestrian, the vehicle involved, and the circumstances leading up to the crash have not yet been released.

Authorities have not yet shared information about:

Possible factors such as speed, impairment, or visibility

Whether the pedestrian was in a marked crosswalk

Roadway lighting or traffic control conditions

Fatal pedestrian crashes often require extensive investigation, including analysis of skid marks, vehicle damage, surveillance footage, and witness statements.

Florida consistently ranks among the most dangerous states for pedestrians. Busy roadways like Manatee Avenue, which carry high traffic volumes and higher speeds, can be especially dangerous for people on foot—particularly at night.

Common contributing factors in pedestrian fatalities include:

Speeding or failure to yield

Poor lighting or visibility

Distracted or impaired driving

Inadequate crosswalks or pedestrian signals

A serious vehicle-versus-pedestrian crash in Palm City on Tuesday morning left one person critically injured and resulted in traffic delays along a busy roadway, according to the Martin County Sheriff’s Office.

The crash caused traffic delays in the area, and motorists were urged to use caution while traveling through the intersection as deputies and first responders worked the scene.
